Hi everyone.
I got a letter today from the dla people saying I've failed the claim.
I can understand why, after reading thru all the dla threads on here and other advise boards I realise I totaly filled in the online questionaire wrong. I did not send any covering medical evidence, did not emphasize how i'm affected, never told my gp and the page on the form that ask's for details of any person who knows you that can help them, well, I put my gp in there by mistake coz thats who I thought they meant, then I turned the page, and straight off they asking for details of my doctor and any other healthcare provider I see...so the doctors details got put in twice on the same form. And I never made any kind of personal stament which it seems is important as others on here have pointed out. I really seem to have messed things up.
So, I'm thinking of appealing..is really hard work as I dont know if I'm fit for a long drawn out legal battle.
Would it be better to leave things alone for a couple of months and then apply again only with proper help from somone like C.A.B. or a solicitor?

You are probably better off going to a cab advisor especially as you feel you didnt fill in the form as well as it could have been, they will help you do it properly for the appeal. From what people have said on here you only get 4 weeks to appeal so youd need to have an appointment booked asap really. Sorry tha you were not succesful but hopefully it will go through with an appeal. Didnt you have a medical for the dla claim at all?
I wouldnt leave it for a couple of months as if you appeal your claim gets backdated to your first application, you would be back to square one and lose out on backdated payments if you start again in a couple of monthsThanx

Met with welfare rights Monday, She read through the paperwork and thinks this will be the easiest case she has done for the last three years. EMP report states I am at risk of falling, DR says it but DLA state I am not at risk. They also have around 6 or 7 more things "overlooked" so am holding out lots of hope that we will win this. will keep you all informed.Only through Christ can we find freedom0

I have rang the dla today to see if I can get the higher rate of dla but reading this I feel sick!!!
i was awarded dla with care at the lower rate and high mobility in 2002 and as my care needs have inceased I have been told by a number of people to get it sorted, the guy I spoke to told me they may reduce my payments or stop them altogether, is there any hope should I continue? I suffer with degenerative disc disease in my neck,(2discectomies)severe osteoarthritis of the spine, cervical myelopathy, CRPS, leg problems an arm that doesnt work properly and now youv guessed depression!! can I cancel my request for asking for the form, I am now worried to death they will stop my payments!! or do you think I am panicking? are there any sites who help you fill them out? I just tried doing it on the government gateway but am not able to sit still long enough to fill the thing in!!

I think thats just the standard reply to all requests to re-evaluate, you know the disclaimer, investments can go down as well as up??;)
No doubt it will frighten a few but if you were awarded the levels you were and you are convinced the situation has worstened for you, you would be foolish not to pursue it:TI like the thanks button, but ,please, an I agree button.
Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

I can totally understand what you mean about reading all this stuff it does scare you to death and make you think its best not to apply but from what you describe if it were me in your position I would re-apply as your problems have increased not got better.
If you mean you have just requested a new form I would imagine that if you decided not to try to apply for higher care it wont make any difference as you will not have filled in the form and sent it off.
I recently filled in a DLA form by downloading the pdf version of the form from the dwp site (can get you a link if you like) and then you can fill it in as you wish. You can save how far you have got so can have as many breaks as you want to, I think it took me 3 weeks to fill mine in and I found it a massive help to do it that way but remember to save it each time
People on here usually say to get help with the form from benefits and work site or dial or a welfare officer or CAB who can help you fill in the form, as its been a while since you applied being 2002 it will probably be best to get some help from the wefare officer or CAB so that you have the best chance in getting higher care, they are used to it and have trained employees to help youThanx

Always always go to CAB or DIAL when filling out these DLA forms!
I filled the for out some 3 years ago and it was refused, we went to a paper appeal with it and my other half was awarded low rate mobility which we had for a year.
We filled the following years form out again and he was awarded low rate care and mobility.
I then filled the 3rd years form out and he was denied DLA so I went to DIAL and over all it took 9 months for it to go to a verbal appeal that we all attended, it was a horrible time being questioned and not being able to say anything but we managed to win back what they took off my partner and they raised the care to middle rate with the low mobility.
We had the renewal forms through at the same time as the appeal and I had those filled out a few weeks ago with the help of DIAL and they have awarded him the high rate care and low rate mobility until 2011.
Getting help from CAB or DIAL does help alot. My hubby has uncontrolled epilepsy and does use a wheelchair when we are out and about, but i'm not arguing over the low rate for moblity. I just think we are lucky to get what he gets now after all the trouble he has had to go through and the DLA doctors not knowing anything about EPILEPSY!!0 -
Scooter_gal - We are waiting for our tribunal date and are seeing CAB tomo about my husbands claim. He also has uncontrolled epilepsy and when they turned him down (after he had been recieving DLA for 5 years) they stated he had no chance of having a fit!! Im sure they are all idoits there!!!0

You do not need to go to CAB or DIAL, (whatever that is).
Just tell it as it is, in full. You will get the correct result.
The comment about DLA doctors knowing nothing about epilepsy is to be honest naive.I like the thanks button, but ,please, an I agree button.
