  • Had the result through today and it's still NO. They have sent it to an independant Tribunal but by the sounds of it the dont think he is ill enough to get it. Well have to carefully read through the paperwork and make an appointment with CAB.
    sorry to hear this, we are using the local welfare rights office you get them to come with you to the tribunral as a representative. gives me more hope now they agreed to take on our case.

    no way can they turn you down with him being epileptic, you should have gotten it from the start.

    Today I dot a letter from my physio saying she will do a reportbased on what she knows of me and how my back problems effects me personally, she also says she will state how as I have had problems for the past 20 years it is not expected to get better anytime soon even after the operation the pain and nerve damage will remain long after bone is fixed.

  • It is driving me up the wall. We dont really need the hassle but not going to give up. Going to phone CAB on Monday to get an appointment
  • We are in a similar situation. My husband foot was run over by a fork lift truck at work a few months back. It crushed every bone in his foot and it couldnt be fully repaired.

    He cant walk or stand on it, it is still in a cast and is agony majority of the time even almost 5 months on! The surgeon has put in the report his foot will never be fully mended and he will always having walking impairments.

    We got the higher rate of mobility from DLA as he can barely walk 5 metres and then can stumble and fall but nothing for the care component! :rolleyes:

    So they acknowledge he cant walk or get about but dont think he will need help with anything like cooking his meals, getting him to the loo, washing & dressing him etc etc :mad:

    As said its like they dont read our forms. It is a joke. We have appealed and still waiting to hear.

    From what we read on here they seems no set logic to how it is awarded, just all seems to be down to luck.

    my husband says he is being made to feel like he is bottom of the barrel stuff by them, not just because of the way the appointment was handled but the way they make you feel bad about your illness, seems like they do more emotional damage than the illness itself. Without a doubt the whole system is a great thing, just needs a little more empathy shown when dealing with the claims.

    Still no results here however the decision makers guide is giving me hope as reading through that with the medical proof they have I should be able to get a better award than I have so far so even if they do send it on to tribuneral I am now better equipped to handle things.

    I have similia problems to you though not as bad. I live on my own so any problems seem like bigger ones to me. I have claimed dla in january and have recieved two letters from them over four weeks saying they are sorry to keep me waiting, the delay is because they are still waiting for the doctors report, so for some reason my doc is holding things up..quite what I can do about that is another whole thread.

    I have good days and bad days, today is a bad day, hence me posting in the wee early hours because I can't sleep.

    Hope everyone gets what they deserve. It all seems to be luck of the draw since its tightened up with them on if you get anything the 1st time round.

    I'm waiting on my 2nd claim (fighting the decision with the help of the cab).
    My 1st claim I got dla high mob & mid care because of my arthritis & it was having the time of its life damagin certain joints over with lightenin speed. Even though my new form on the 2nd claim was worded almost the same as my 1st form apart from the add ons of now having aids like a electric tin opener/jar opener because of its effects in hands wrists, walk in shower and mobility wheelchair/scooter for leg and feet damage. Based on info even from gp & consultant at hospital my renewal was put on low rate care last month with the letter mirroring what others have put.. the letter now had things on saying you walk very slow compared to others (yes because of the sheer pain & stiffness) but you can walk without difficulty therefore you're not unable to walk or virtually unable to walk, you manage stairs perfectly well, you have no pain nor stiffness but you can't cook a basic meal for 1.

    It just seems like a minefield. But with the help of your doctors and the people who help you fill the forms in you'll get what you are entitled to. And don't give up because that's what they hope for because your ill doesn't mean you've lost your spirit.

  • Just a quick update. Our local MP is now very interested in our case and we are meeting him on Monday with all our paperwork. SO hopefully that will help to strenghten our case.

    My wife went to bank today and found an extra £515 in, this we found out was from income support who have just looked at the claim and decided to pay an extra £36.85 pw from september when dla started. so nice to find along with the £60.00 winter fuel payment. we are celebrating by ordering dominos pizza tonight and will be stocking up the freezer at asda this week. so good not to have to choose between heating and food for a change.
