I got through to NDL today. I sat and dialed and when it came up engaged, disconected and pressed redial, took me 35 minutes but I got to talk to someone. Patience is the key.

just spoken to hr. they advised me that the policy with regards to financial conduct is as follows. a staff member having an iva or being bankrupt is a severe breach of the financial conduct policy and will be classed as gross misconduct. thsi may well lead to dismissal without notice. he added that basically you will be sacked as its taken so seriously. still dont know if its in my contract. will have to request another one as cant find it. should i resign then?

I would not suggest that you resign until you have seen a copy of your contract - what you should be looking for is something called a Personal Integrity Guarantee in your contract. If it does have this, then it will probably be under the terms of this guarantee that they could sack you. Don't rush into things - you have time to find out about this more before you go bankrupt and even then, they cannot sack you if that is what they intend to do until you have actually done something that they "consider" to be wrong.

i have just found my original contract from 2002 which says if you breach the banks policies or any policies that are amended in the future you could be dismissed immediatley. i have signed several contracts since then, due to hours/role changing and in those contracts it says nothing about policies. there is no personal integrity guarantee in any of them.

    Hi ttt2009 :D

glad you found your contract - can you print out your work's financial conduct policy and go over to see if it specifically mentions you will definitely be dismissed if you go BR. If it only says you "may" be dismissed then it is not a sure thing. It is good that there is no personal integrity guarantee, my contract does not have that either.

If your line manager is insistent that you will be dismissed, then I would suggest that you ask the matter to be referred higher and that you have a meeting with your line managers boss to discuss it further. I know this won't be easy but you do need to find out for definite if they will sack you. I really hope that it does not happen.

If you do arrange a meeting with your line manager & their boss - make sure that you do take someone else in with you as an impartial witness so that your line manager and boss do things by the book!

Did you see about joining the union? As it would be handy if you could take the union rep in with you.

    Take care

Whatever your contract says, don't resign voluntarily, let them sack you. It will make getting any benefits easier, plus it will take them time to go through the disciplinary procedure etc, and they will have to pay you while doing this.
