Can you show me where it states that, either in statute or precedent? No, you can't ... because it doesn't!Gone ... or have I?0 -
all this conjecture and speculation is rather tedious isn't it?
surely the only interesting information is along the lines of:
"Ive got it"
or
"they've cancelled my order and refunded me"
versus my 'dad' is bigger than yours0 -

So you knew there was a chance that you would not get the item yet you still insist on filing a claim against them?

Hence the word 'If'. I was pointing out that while I am unsure of our position, I am not dissuaded by the fact that they say 'oooh we're not liable' in their t&c's. Many companies have unenforceable balony in their terms.0 -

Unfortunately law isn't quite that simple. If it was then there wouldn't be so many wealthy lawyers. The "We reserve the right not to supply you at our discretion" clause adds complication to this as you agreed to this when ordering.
It was also an honest mistake by B&Q and none of us are out of pocket so common sense says that refunds are the most appropriate resolution. Don't forget that most of us were trying to take advantage of a probable misprice. Some were ordering the dishwasher even though they had no need for one.
As I mentioned earlier I'm waiting for them to contact me. Not only have they made a mistake on their website but they appear to be hopeless at resolving the issue and sending a polite email explaining the situation. That's bad customer service as far as I am concerned. However, I'm not going to waste hours trying to screw B&Q. My time is ultimately worth more to me than the £280 I haven't saved.0 -

I didn't order anything, but at the risk of getting my head bitten off.......
I like a bargain as much as anyone, but in the current economic climate when even large well known companies are struggling I would rather walk away from an obvious error than cause the company to spend money either supplying the goods at a loss, or paying solicitors to fight the argument. The money this costs could keep people in jobs.
I don't know if B&Q are suffering (I expect they are not immune to the current situation). However, the worst that has happened to the folks on here who did order is that they have had just under £100 out of their account for short while. I think you should be grateful you can afford £100 at the moment. I doubt this fiasco alone could cause B&Q to go under, but it could be another straw on the camel's back, and if they do go under think of the job losses:rolleyes:
Sorry...rant over.0
