  • I am no expert but if your company is still trading which you must be doing because you say you are selling the old stock off (and of course selling gift cards) how can you not be liable for claims for money against you.
    And I have a ltd company and I am still personally liable for any debts the company runs up.
    Anyway I not supprised you can't recall Matteus240 and you have obviously got many unsatisfied customers

    No, that's exactly the thing with a limited company. The directors aren't liable for any more than they're original share capital. However if there is fraud or embezzlement involved, like it would appear to be the case, then the directors can do a sizeable jail term.

    I'm reading this that:-

    a) In all cases you have applied for the judgements to be set aside
    (Seem reasonable to me assuming you have a valid argument)

    b) As you have applied for set-aside there is no longer a judgement against GC's PC's
    (Only true if the application for set-aside is upheld)

    c) GC's PC's need to agree to a Judgement
    (not true a Judgement is binding until set-aside by the courts)

    d) You are only re-paying creditors as part of the winging down of the company
    (worrying if true!)

    e) You agree that the name of you company is GC's PC's and not the GLC Group!

    My understanding of this (I am not a lawyer) is that the set-aside is basically a request to have the case re-heard, it doesn't mean that the defendant is necessarily innocent.

    Hi .. Companies House say no money involved but GCs PCs didn't file its annual returns.. so CH has moved to strike GCs PCs off. However once this happens there is no company - so any creditors have no one to chase. If anyone such as matteous has an outstanding claim against GCs PCs they should write to Companies House asking for a postponement and to say why. You can write, fax or email the Dissolution Department at Companies House eg email is [EMAIL="enquiries@companieshouse.gov.uk"]enquiries@companieshouse.gov.uk[/EMAIL]
