    She is probably getting Income Support BECAUSE of incapacity as she probably didn't have enough NI contributions for actual Incapacity Benefit, so no one has been diddling her out of anything.

    That was the thing I was not happy about because if her parents had known about incapacity at youth she would have been eligible.

    I was just trying to see what she could get if I started working (My own business).

    I now know off some helpful people on here she can get WTC + she had DLA.

    She will be working with me for about 4 hours a day 5 days a week, 12pm till 4 pm.


    She gets low rate mobility and middle rate care.


    Is that right, I don't want people saying I am trying to commit benefit fraud when I am only trying to get to the bottom of what she is entitled to.

    But you've said that if you start a business it'll hardly pay you a living wage. How is it going to pay you enough to enable you to pay her nearly £120 per week as well as paying yourself?:confused: Not only will she have to pay NICs out of this but you'll have to pay employer's contributions for her as well.

    Why not start up your business and see if it will support you before looking at all this? She can still help you unpaid. If it doesn't pay enough to support you then you certainly will not be able to afford to pay anyone else. What sort of business are you thinking of?

    One thing you ought to consider OP is that as an employee your GF must be paid minimum wage and I would imagine you will need to supply wage slips etc to prove that this has been done.

  • If we started the business as partners would that not be better then employing her, which I wanted to do in the first place.

    Technically we will be partners so if it helps in any way and is better then her working for money and work involeved ,I would do that then.

    Also if we did do the employer way, I could change the hours she works if we don't make enough as long as it is over 16hr is that right.

    Also as long as I pay her a wage, do I have to make a full wage or I could do the same and only work a set amount of hours.

    I am not going to work 30 hrs and get nothing where 16 hrs would make us as much as 40 hrs.

    I am going to get into contact with the business hub and citizen advice bureau, is this the right people to talk to.

    This is my first go at doing a business and I want it to work.
