Everything. The 2 points I received were for:
"Are you scared or anxious that work would bring back or worsen your illness?"
    and
"Are you too frightened to go out alone?"
There are another 17 questions that have wrong answers either by her putting the opposite of what I said or not asking me the questions in the first place and making her own assumptions.

I tried to call our local citizens advice earlier but they were closed. We are going to go see them tomorrow morning for their walk in appointments.

Another thing we have noticed on the letter is they did not contact my doctor for my medical information and they didnt contact the person I gave for more information which was my CMP advisor.
Looking at my statement what I wrote on the IB form and comparing to the answers the medical professional has written, they contradict each other. Yet they say they used my questionnaire AND the medical report for their decision, well if the result is anything to go by they have totally dismissed everything I said on the questionnaire and gone with just the medical report.
It says on the letter that I can ask for a copy of my medical assessment report, are there any letter templates for this? Also would I be able to ask for previous reports also as they will prove my condition.
    Thanks

  • They do favour the medical report over your IB50 even if it contradicts also they dont contact your doctors etc. This is one of the most annoying things cause my neurologist wont give a report for my appeal at my request but will if they request one apparently he not allowed to same with my orthapedic, ENT and Maxilo facial surgeons yet its up to you to prove you are unfit to work - well how  especially when everything is against you this way.

Only your GP can write on your behalf and you can ask him/he for a supporting letter to go with your appeal.

Contact the law centre as well as CAB before you do anything the CAB got bit of info wrong with my appeal it didnt hinder me as Law centre sorted it out. Either may be able to send someone with you should you need a tribunal it a bit of a postcode lottery that though.

Yes you can request the full report not sure about previous ones just ask for it on appeal letter

Hi, I went to CAB today but they wouldnt see me as they were too busy.
So instead, I called the Community Legal Advice number on the letter I received to say my IB had stopped. I didnt expect much since its DWP giving the number out but the woman I spoke to was really nice and willing to help. She says I can either use her help or choose someone from a list she will send out and that person may be able to accompany me to the tribunal should it get that far (probably will). She also said not to expect much from DWP after I send my letter to disagree with their decision as they will most likely stick to their decision so it looks like I will have a fight on my hands. But like my Husband says, what do I have to lose? They have already done the worst so the least I can do is try and fight for myself. I would like to have someone represent me should it go to a tribunal as I will get so muddled and wont be able to think of what I need to say. Now we just have to decide what to do about our financial situation, apply for JSA or IS at reduced rate which will take some time to pay as they need to have my appeal.

  • i did worry u may not get in at CAB they are useless in my part of the world but some people swear by them and they can be quite resourceful.

I think you are on the right track honeyD and your husbands right you only lose if you dont fight it. Its another long draconian process though Im afraid. Good Luck

I am getting more anxious at reading about your situation HoneyD, if they stop my money I cant even claim JSA or IS as partner works (for what its worth his wages only cover the rent, council tax and half the bills)

I forgot to say earlier, but I called the jobcentre number on the letter and spoke to a guy who said "It doesnt just go off the answers you give, its also the ATOS persons interpretation of what you say" Well, If I say yes and they interpret it as no, how? Lol, was one of the funniest things Ive ever heard.

  • The medicals dont work if you dont have the right doctor. At my first medical I treated to much like a doctors appointment and didnt stress how much I couldnt do and how often I was just rambling really as was on a lot of strong pain killers to get there so I appeared as a happy little bunny and got annoyed when the doctor kept asking if I was sure I wasnt suffering a mental problem in those words.

I didnt realise that they classed depression as a mental factor on the test so in my saying no I have no mental problems I wasnt even tested on that basis when I should have been.

I would advise anyone going to a medical to look up as much info as possible before hand to help you get your point across in every question they ask you only have 20 mins to give that person a picture of your illness and how it effects your daily life.
