The difference here, Neil B, is that there will have had to have been a sign saying what will happen if you dont pay for parking there. Can the OP confirm there was/wasnt a sign present? If there was, theres no excuse to moan about it. If there isnt a sign up then you can easily refuse to pay.

Hi its my first time on here so any help much appreciated.
got a ticket dated 22/10/08 was ten minutes late £100. its a private company called pps. valley enforcement.
its £130 now as i ingored it and throw it in the bin. ive told them i never had no ticket on the car and they have sent me a copy which i recieved today.
i was told as its private i dont need to pay and just tell them i was not driving the car, and dont have to disclose who was is this correct?
does anyone have any other ideas?
    many thanks. steve..
Ahh, you made the mistake of contacting them, so now they will think they have a fish on the hook, and the pestering letters will go on a bit longer.

Best advice is to ignore anything they send you, most of these PPCs won't go near a court because their invoices are utter rubbish. They have to prove that there is a debt, not the other way round.

Also ignore the ignorant replies from people describing this as a "fine", it is no such thing, it is in illegal penalty charge.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Yes it does sound easy. Some one can make a claim or an allegation of a debt. It is left for you to dispute.
The techinal definition is that it is still clased as a debt until u can prove the person requesting the money is chatting rubbish or has no valid proof etc

There is nothing to prove and nothing to dispute. He has no obligation to do anything at all.
The only 'debts' with any validity are those registered at a County Court - in this case about as likely as
think up your own analogy for 99.99%.

A clear, prominent sign with appropriate wording to suggest he entered into a contract. - unlikely.

Legitimate paperwork that does not pretend to be from an official authority or refer to legislation that is not applicable or use expressions reserved for those authorities. i.e. not fraudulent. - unlikely

Personally I wouldn't care if there was even the remotest chance of both of those happening. I still object to the behaviour of these companies, in many cases 'inventing tickets and in virtually all cases sending very threatening and frightening letters to, often, vulnerable people. That further documentation frequently also being fraudulent.

    Fight them at every turn!

I've got an idea that is as relevant to Mr Wham than most of the comments on here.

Why don't we just have one thread where everybody can make comments such as 'Pay up you deserve it', 'Stop whinging and pay it', 'it's your fault', etc etc, then these people don't have to go through every thread inserting their unhelpful comments and putting off those asking for help. Likewise i'm off to find some forums I know nothing about and pretend to make some helpful, ill-formed and potential contra-helpful statements ('No, you don't need stitches for that, just add some horse manure').

I can't see Mr Wham asking for people's opinions, but advice which is beginning to be hard to find amongst the rubbish, like a lot of threads. Can people just not bite their lips? He / she must be wondering why they bothered.

oh and there was a sign saying what will happen, but i still dont believe in charging this amount of money for 10 mins, i think i will tell them i will pay for the late time only as it was £1 for one hour thats 10p and sounds about right. hey what if i was a little old lady collapsed in the shop and never got back to the car untll 20 mins i should pay £130 should i?

    Defeated :D (thanks again!)

But I might not have pursued it if I'd have gotten the same response from some here. ;)

    Anyway, i'll butt out!
