Debt Relief Orders (DRO) - Information & help thread

Just wondered whether the 2 days was from the very start, meaning when you've contacted them or from when the application form has been completed and submitted?
I'm in the process of applying for a DRO with the help of CCCS, not completed the form, I've just sent them info of my income and debts but have been told they are in high demand so could be several weeks before completed.
Back in May, I was in a very long waiting list with National Debtline for a DRO.....I expect the waiting list may be even longer now.....
I just couldnt wait the 6 weeks for the DRO to be assesed as creditors were beginning to pester....
In a vain attempt to speed up the process I rang Baines and Ernst fully expecting to be placed on another waiting list.
To my surprise, they dealt with my application there and then on the phone, emailed me my barcode, I popped out to pay the fee, rang back to advise of fee payment, and application was sent there and then. About 3hours in total. I heard off acceptance of DRO 2 days later.
I must add this was back in May last year, when DRO were very new.....waiting lists may have increased with all intermediaries nowI used to be Snow White, but I drifted.Mae West

Thank you for responding I may have to give Baines and Ernst a call to see what their waiting lists are like. Hopefully it'll be a bit better and only be a few weeks.0 -
I sent all my paperwork off before christmas and when i checked with them yesterday they said the paperwork has been approved? and i would be contacted in about 3/4 weeks.
I have a 'potential payment' from child tax credits of around £1700 would i be allowed to keep some of this? my hubby thinks we will get to keep this as it is a 'benefit' although i expect them to take it all?
Potential payment arose when they did not adjust the paymennts when i informed them i had handed in my notice after maternity leave (they changed me to not working but left my income the same)
We are despertley in need of a newer safer car.

In a DRO, its not like bankruptcy, the IS wont "take" your money, your DRO will either be refused, or withdrawn if it has already been approved.
I have a feeling, the payment, as it will take you over the £300 assets limit, it will void the DRO.

I am just stunned that after finally sorting things out i get a letter saying - oh we owe you some money and that might wreak the plan i have put in place already

Should i inform CCCS that i have this money pending? as if i dont recieve it nothing will have changed? Tax people have said will have to wait for end of tax year before they can tell me if we will be getting this or not? It is a joint claim with my husband would they still count all of it. I have yet to speak to somone about DRO they said the caseworker would call me in around 3 weeks or so....
If it was denied could i then 'go' bankrupt? (i would use the money for the the fee ) It was suguested that a DRO was my best course of action as my debts are around £10,000

The worst case scenario would be that the DRO is accepted only for a few months down the line, it would be revoked. You would lose your £90 and creditors would then be free to chase their debts once more.
Im unsure about it being a joint claim, but even if they only considered half the money, it would still take you over the threshold.

I have spoke to CCCS and the nice chap said i have 3 options.....
All of which involve halting my DRO which was due to be started very soon acoeding to him... he has placed my file on hold at the moment.
1. use any money recieved to pay creditors - then see if a DRO can be put in place, he thought this may be unlikley.
2. use 'some' of the money for 'kids uniforms shoes birthday presents etc (his words) keeping reciepts and offer the rest to creditors
3.Cancel DRO and use money for other things
I have also spoken to TAX CREDITS people and they said they cant tell me if or what i may be entitled to and i will be informed between april and July.
Whatever happens i cant 'do' anything until April at the earliest i just want to be able to answer the phone and the door again.

I have NO ideas as to what to do for the next 6weeks+
I have debt collection agencies writting to me daily and the phone rings all day (i dont answer i 1471)
After speaking with CCCS yesterday i thought it would finally be sorted in a couple of weeks and now i find out i can start the whole process again in 6 weeks or so... if i am really lucky.
what REALLY peeeees me off was the attitude i got from tax credit people.....
