Debt Relief Orders (DRO) - Information & help thread

  • I went through the Debt Relief Order process yesterday. It was rather stressful and the advisor was not that understanding to be totally honest (from the CAB), my debt had been run up due to mental health issues but he could not seem to get his head around that. It made me feel even more ashamed than i already do. But i have figured that whats done is done, and beating myself up more over it won't get me anywhere, i just need to move on and try to learn from this and make changes in my life. I am relieved it is all over and feel for anyone going through the same experience xx

    I'm sorry to hear that you found the DRO process stressful and the adviser not understanding.

    If the adviser was trying to enter data on-line during your interview, he/she was probably getting stressed by the website - it tends to jump around after every data entry. At that stage it's just about getting the data input, so it may be that he/she was just concentrating on getting that right rather than considering your feelings.

    If you have paid the £90 and the adviser submitted the application yesterday, then it may have been approved today and hopefully your adviser will be confirming that to you.

  • please help, i am so upset, i have had quite a bad year, nearly lost our home but were saved by the mortgage rescue scheme so even though we no longer own our own homw, we get to stay there and our now paying a much lower rent than our mortgage was. this all completed on the 4th december . still had some debts to sort out applied for a debt relief order as i now met all the criteria, debts under 15.000 don't own a home etc
    my intermedary assured me it would be approved. however , it was revoked because my mortgage and mortgage arrears are still on my credit report, taking my debts to over £15.000 with a mortgage, i applied for this after the completion date and just assumed it would'nt be a problem. i can't afford to pay my debts or make myself bankrupt and can't get my £90 back. what can i do?
  • Would my debts be considered under a DRO? I have a tv and sofa that I can't afford the repayments on, as well as a landline, contract mobile and Sky tv.

    It's complicated because all these things are in possession of my ex-when we split we agreed to halve our debts, even though they were all in my name. I paid off 3 grands worth of store cards, and she agreed she'd keep the tv and sofa and pay for those (about 3 grand all together). She'd been messing me around with these payments, and the other day after a row announced she was no longer going to pay them. I only get jobseekers allowance at the moment, and my outgoings mean I cannot afford to pay these 2 companies what they are owed.

    Her Sky, Bt and mobile are also in my name-at the time when the split was ammicable it was agreed that we would leave those alone until we were in a position to cancel them (neither of us could afford to pay what it would cost to get out of the contracts)-the idea being that she would keep paying them as she was still making use of them.

    Hi,
    Unfortunately there is little you can do. Everyone should check their experian report prior to a DRO, as information, correct or not, will be used by the IS. Have you discussed this with your intermediary ? Did they ask you to get your credit report?

    Hi,

    I think you would be at great risk of being seen to have preffered creditors ( ie the one's you paid off in full) and would lose your £90. You would need to leave 2 years between this prefference and an application for a DRO.

    Not sure if anyone can help but i am looking into applying for a debt relief order and i qualify on all counts apart from my car, it`s worth £1300 BUT i need a car as my daughter has chronic asthma and has regular trips into hospital (3 in the last month) is there anyway i can keep my car? Do they sell it/do they make me sell it/can i but it back?
    Any help much appreciated.

    I think you would be at great risk of being seen to have preffered creditors ( ie the one's you paid off in full) and would lose your £90. You would need to leave 2 years between this prefference and an application for a DRO.

    Thanks, but it's a moot point now. I talked to someone at the National Debtline, and they said I didn't qualify for a DRO as I have a pension worth more than £300 from an old job, and that is considered an asset-we both commented on how ridiculous this is, as you can't cash in your pension plans and I have 20+ years until I see any benefit from it!

    I couldnt agree more regarding the pension - its just plain madness. CAB are challenging the government on this issue in January, so things might change.

    Sorry but if you own the car and it is worth £1300 you cannot have a DRO.
