My mum, a widowed pensioner, wants the CAB to put her in for a Debt Relief Order. However, will this mean that she will have her two bank accounts - Barclays (owes them a £2000 loan) and Halifax (owes them nothing and is the main account into which her weekly pension is paid) - frozen? Surely they won't freeze the Halifax one, will they?

Also, she is puzzled as to why the CAB haven't automatically put her in for a DRO, and she has to keep contacting them to ascertain what the situation is.

The Halifax curent account should be OK (I presume there will be less than £300 in it).

The barclays current account will not need to be listed unless it is overdrawn but you are right in thinking Barclays may well close it if there is a loan attached to it.

It's hard to speculate why the CAB have not suggested a DRO - there could be a few reasons. She needs to ask them directly. The last time I saw figures, the majority of DROs were still being done through CABs but that does not mean that every CAB will necessarily have an 'Aproved Intermediary'

Some CABs have very long waiting lists and are not taking on new clients until the backlog has been cleared.

    P.S.

This is going to be a bit of a mess but if you can see your local CAB bureau here then it should have the capability of submitting a DRO:

  • Hi all...I've finally succumb to the fact that I am in one holy mess financially and need help. I meet all the criteria for a DRO and I've just called my local CAB and I'm going in to see them on Monday morning. I'm in about 13k of debt and on Benefits (single parent) so I'm really hoping it can be granted. I really wish things hadn't come to this but...

They won' t close my basic Halifax account will they? It's the one I get my Benefits paid into and my direct debits for bills etc taken from! :( I really hope not! I certainly don't have over £300 in there or any surplus cash at the end of each month...chance would be a fine thing.

From personal experience The Halifax treat DRO's the same as Bankruptcy as far as I know and that is not very kindly, I would recommend you get a cashminder account with co-op or the basic Barclay's account set up front, they have the same facilities you will currently have with being able to accept benefits and setting up DD's and will not close it once they get the order through. Hope that helps, if not what you wanted to hear.

Slowly getting there..thanks to all the help on here

Accounts not overdrawn are not listed on the form. So if you have no debts to the Halifax (or maybe I should say the Lloyds Banking Group!) then Halifax will not know you have a dro. The Insolvency Service themselves will have no interest in your account.
  • Thanks folks! It's an awful time of year to be trying to sort all this out but from what I gather it's hit and miss on how long the whole process will take from start to finish.
  • After 6 years can anyone find out you had a DRO?
  • Currently compling everything for OH and have a some of questions. Going through CCCS but their helpline is a nightmare to get through on.

Do I need to send bank statments if I send in his benefit award letter dated April09 as proff of income?

Will Barclays close his basic account even though he has no debt with them and runs the account well?

Not all of the debts show on Experian so I have obtained Equifax which has more but for some reason neither show the Monument debt even though I have a letter chasing dated Nov 09. Is this a probelm as paperwork states everything should be on Experian report?

Do I have to have a letter ref the CCJ its on the reports but we cant find the paperwork and its a pain trying to get through to Northampton Buld Centre that has the details?

Thanks in advance. I will investigate more next week but so want this done as he has sat on this for months :(.

Will Barclays close his basic account even though he has no debt with them and runs the account well? I have an account with Yorkshire and they haven't closed mine - if its a basic account that they allow bankrupts to open I would think you'd be ok but might be best to check with them.

Is this a probelm as paperwork states everything should be on Experian report? Two of my debts that I included weren't on either credit report and I was able to add them ok.

On that one you would need ref no I would think - but one of the more knowledgeable people will be able to help you more on this.

Best wishes with it all - this is just my experience and a few bits I have picked up from here but one of the more knowledgeable members will be able to help you a bit better than I can.
