    Just found this on a council website and it does say that social fund loans CAN be included. :)

    Yes i included on DRO, if i remember correctly it was allowed to be included on the relief, like you said lets see what Fatboy says.

    Hi all,

    Well, after 3 years struggling to get on top of monies owed (that's what a business going down the toilet does to you!) I was granted a DRO early February 2012. However, in the past 2 days I have received letters from the various agencies (and some new!) who were dealing with the 3 amounts deemed owing.

    Is it best to just write to them and enclose a copy of the DRO, requesting they cease contacting me immediately? One of the DCA's (Aktiv Kapital) has written saying they are 'aware of insolvency proceedings' but require proof?! I'm almost tempted to ignore them as they're more than welcome to waste their money on more letters, etc. if they so wish!

    I would simply get a photocopy of the approval letter you were sent by the IS and forward it onto them... If they continue to hassle you ask the DRO Unit to resend notifications...

    I now have copies printed with accompanying letter attached - hopefully that puts paid to any more threatening contact from them.

    10 more months to go! :)

    Social Fund loans are now excluded debts, but only for applications made after the recent change.

    If the loan was definitely listed in the DRO, and they are aware of it and the DRO pre-dates the recent change, can you ask for an explanation from the DWP for their behaviour that you can copy and paste to this board?

    A friend would like an assistance please?
    He has lots of debts including cc and planning to do an IVA. He earns about £1400 monthly and all goes on paying bills and cc. He has 2 mortgages - both properties are on negative equity.
    He lives in one with his family and let out the other - rent collected is just enough to pay the mortgage.

    The question is, if he goes into an iva, will he lose both properties, as he does not want to end up on the street with his family?

    What is the best way to approach his debt.

    If you are currently in contract on a mobile phone how do you include this on a DRO, should you wait for collection letters with full amount owed, if not how do you determine what amount to put?

    Also are you allowed to be in contract if you can afford to keep it?

    If you can afford the contract and the monthly spend is within the trigger figures (your Intermediary has access to them) then there's no problem keeping your contract.

    If you have to abandon your contract then there is likely to be a hefty termination fee. Ideally, wait for this to be calculated. But if you have to submit it quickly then you'll just have to do the best you can with the figures.

    One other thing, are you allowed to renew or get a new contract and will the dro effect this?

    Well, the DRO is going to show on your credit file and, for a new contract, the mobile phone co are going to do a credit check, so I wouldn't go there. I understand you can renegotiate an existing contract but I'm not the expert on that.

    For a rough idea on the trigger figure, for a single adult £33 per month would be within the figure.
