Hi i dont know if im in the right forum but i hope someone can help.
My husband went through a DRO in april this year we had seperated last Nov all council tax bills were in his name and never joint names i was never a tennant at the property it was all in his sole name.

Now since he had the DRO the council are now sending baliffs after me and saying that i am responsible for his debt, what can i do? as i have no intention of paying im on jsa at the moment as i lost me job when my marriage ended.
How can they come after me when none of the bills where in joint names ever !!!
All the debt and financial issues were half the reason we seperated.

I have told the council to put me in prison as i am not paying it !
im really sorry about your situation, and as far as i was aware, as long as no debts were in your name then you shouldnt be responsible for them....was your name on the rent book ? iff not then i dont see how the council can expect you to pay your ex's debts...wait for one of the experts to come on, they will have more knowledge than me...xx

Who has to pay council tax

Usually one person, called the liable person, is liable to pay council tax. Nobody under the age of 18 can be a liable person. Couples living together will both be liable, even if there is only one name on the bill. This applies whether the couple is married, cohabiting or in a civil partnership.

If bailiffs are involved then the matter has already been through the magistrates court and there is a Liability Order against you. If you had evidence that you were not liable for the period in question then you should have challenged it at that stage. But as an adult, and resident, you were liable for the time you were living there, unless you were exempt due to special circumstances.

If the Council cannot get payment from you by any of the options available to them, then there will be a committal hearing at which the judge will decide whether you are wilfully refusing to pay.

Do you have other debts? Should you be doing a DRO?

Well my brother has now officially moved out.
My mum rung the council yesterday to tell them so now we have to wait to find out if they are going to change her rent payment plan for the arrears and see if she owes any on the council tax.
Then we can reallocate the money elsewhere.
Although she has just had to order a new washing machine via my sisters catalogue so we will need to add that on too!
I'd rather it all be sorted before we pay the fee then at least they have all the right info!

Everything will be ok in the end, and if it isn't ok then it isn't the end :)

id be very weary of ordering something so close to the dro....especially as your mum know's full well that she cannot pay for it...if the catalogue objects to the OR it wudnt look too favourable....your mums dro could be refused or revoked iff the OR deems it to be reckless spending......its not a very nice thing to do to your sister also.....does she know that your mum wont be paying for it...

We don't think she will have to pay the council tax so that £15 is what she is planning on using to pay my sister for it. Her washing machine had packed in so she needed a new one and obviously didn't have the money to go out and buy one.
What do you mean by the catalogue objecting to the OR?

Everything will be ok in the end, and if it isn't ok then it isn't the end :)
