Couple of questions for you clever folk please
My husband and I are looking at a DRO each, I understand the £50 or less disposable income - as pretty much everything is joint is that £50 (less than) each or joint in the family budget ( we are on benefits and everything goes into the "pot")?
We are also hopeful of some PPI from the bank after the recent ruling how would this change things?
If one of us were to find a job that drastically increased our income (unlikely but possible) how would this affect us if it was within the "moratorium" period?
Social Fund loan - is this added to DRO as we obviously have less benefit coming in due to payments to SF?
Is DLA (my sons) taken as income?
Thanks0 -
Not sure if someone replied to you about the DLA but I found this when searching for the answer myself:
http://www.i-m-a.org.uk/pdfs/intermediary-guidance.pdf
Page 44 it states: The debtor‟s income could derive from various sources, including wages, benefits and pensions. All benefits should be scheduled, including DLA, and in the instance of DLA, it is acceptable to record the same amount as expenditure.
So if you receive 300 a month you can put 300 a month as care needs or whatever.
Everything will be ok in the end, and if it isn't ok then it isn't the end0 -
Thanks I know DLA seems to be a grey area sometimes - but we get it for our son and use it to help him lead a "normal" life - if such a thing exists lol and didnt think he (as it is really his money just he's too young) should pay our debts even though they pretty much came about due to having to stop work to look after himHappy with any wins this year :A0

I found the notes to be helpful as well as like you say sometimes there are grey areas and not just with DLA.
I also agree with scarlett it will help you be less stressed which can only be a good thing

Now as i have posted up here about this before the bank do not hold any details about me, i even went into branch today the said your account is passed to our debt management and is clear in our part. so called debt management they couldnt find anything either and advised me its too old.
Now the adviser says he either wants the above or a letter from the bank/mobile company concerned to send me a letter to confirm i do not owe them any money (they will not do this) or he wont put my dro through and keeps insisting i declare bancruptcy as all debts are included.
Can someone tell me if this is the case and if not what i should tell him. Also is it possible to ge all me documentation back and go through a diffrent company and not declare those debts or will the draft aplication be a problem.
Sorry for long post.
Any suggestions?0
