Debt Relief Orders (DRO) - Information & help thread

oh my god I am really panicking and stressed now
I will include the JSA and full bills but I would not be paying the full amount anyway as my partner would be, and I would just be paying a contribution...
So say I would be getting £65 per week max, and I paid a contribution to my rent and household bills, as long as my surplus income is less than £50 per month, I would still qualify for a DRO.
I am really sorry if this is confusing and I really appreciate the help and advice from everyone, I am finding this hard to get my head around.
First off take a chill pill and don't get stressed. Now concentrate on your BILLS and OUTGOINGS. It's done on what YOU have coming in and what YOU have going out. So as long as any debts you want to include are your name only that is fine. It is the same with bills, food etc, just yours is all that counts and as long as your surplus amount left over each month ranges between £1-£50 you should be fine.
What i don't understand though is that if your partner pays all the bills how have you got £900 going out per month..?0 -

Oh I'm sorry that was me being silly and basically saying that all monthly rent and household bills were my responsibility which they are not at the moment :embarasse
Ok so trying to think with a straight head now,
All of the debts which I would like to include are all in my name, rent, council tax and most bills are jointly in my name but obviously I am not contributing towards those at the moment.
I guess I will just have to see what the advisor thinks on thursday and cross my fingers and hope for the best.
Thanks for your support and advice!0 -

You'll be fine. Get your figures straight before you go in and you would have done the advisors job for them. I got everything togther went through it with her and the first thing she said was go for a DRO. From then on it was plain sailing.

Please don't panic, one of the biggest jobs we have is sorting out people's financial statements to ensure they are A) eligible and
accurate. Don't lose sleep over it, just make sure you're prepared and details details of your bills/income/bank statements to your appointment.

But just had a call from the local office and she was NOT, told me its classed as a fraudulent application. Says i must have known id never be able to afford payments, ( i told her that up until Friday i didnt know my hours were being reduced at work)offered me reduced payments, but i said i shouldnt do that as it would be favouring one creditor over another.
Im at work now so cannot call cccs for advice
Call CCCS at your next available chance. If provident do feel it's a fraudulent transaction then they may appeal the DRO on the basis of it being fraudulent and the OR would then investigate it further, and possibly either revoke the DRO or if they agreed it was fraudulent you would remain liable for it after the DRO moratorium has ended. Worst case scenario the OR or Provident may wish to prosecute you but there would need to be clear evidence that you were intentionally defrauding them.Total 'Failed Business' Debt £29,043

Thanks for all your advice immoral angel
I spoke to cccs this morning, they advised me to carry on giving token payments ( even if its only £1 per week) and then apply for DRO in about 3 months
Was hoping i could get everything up and running before Christmas but i guess i'l have to wait awhile.

Personally i would just say that you didn't know which way to turn. There are many 1000's of people i suspect doing that very thing rite now, taking out loans to get them out of a short term hole. If it were me i'd say that you knew it couldn't carry on hence meeting an advisor or a call to the cccs. I would then say that it was on their advice you applied for a dro. All this carp about fradulent applications is in my opinion scare mongoring by them to get you to pay up.
I think personally the pay £1 a week for 3 months advice is bad as they now know you are in financial trouble and may act quicker to recover their money. If i were you i would press on with the DRO and not mention it.
That is just my advice only though..!!0 -

Said they recomend 3 months to go by before applying so that provident would be less likely to dispute ( and succede)the DRO. Said to make token payments though, so prov will know that im in financial difficulty.0 -

When was the last loan borrowed? I know some organisations are cautious if the loan was borrowed very recently/after initial advice because of the loan company appealing?
Did you speak to the specific DRO department at CCCS or a standard advice line? if the latter I'd recommend ringing the specific DRO line they have0
