    When I've set up arrangements for clients with provident I've always gone through their head office and the payments have gone directly to them, rather than the doorstep collectors.

    I know, was supposed to be 6-8 weeks originally! They said it has taken longer as I have had to send in more information from when some of my debts have been sold to debt agencies and they have needed to check that paperwork as well.

    Baines & Ernst said the waiting list with them is only 14 days at the minute - but CCCS have helped me a lot and I wouldn't want to change intermediaries at this stage anyway, it has been stressful enough already!

    Ok I will write to Providents HO and hope the next 3 weeks fly by, thanks you've been a big help :)

    Sorry to post again but I just feel like crying - I have received a letter from one of my creditors saying that they are taking me to court to get a Judgment Order on 19th April - I presume that this is the same as a CCJ? I know that these can be included on a DRO but everything is so up in the air at the minute - I have just moved back to my parents after separating from my husband and now I have just been offered accommodation somewhere else for me and my son. I am worried the court will refuse my offer of £1 a month and I will have to go to a hearing and I don't know what address I'm going to be at, my benefits haven't been properly sorted out, I'm just so fed up. Why can't they just leave me alone for just another month then my DRO would be done. Moan over.

    I'm trying to understand what you are saying and (this is my second attempt) I think that you have just had a threatening letter from a debt collection agency, not a court claim form from an actual court. Is that right? If it is, then they are months away from getting into a position where they could enforce anything. Just push ahead with your DRO.

    Sorry, I was panicky and typed very fast! My debt has been handed to a DCA (Frederickson International) and in turn they have handed it to Bryan Carter Solicitors. I have had a letter from the solicitors saying if I do not pay by 19th April (bit harsh as I only got the letter today - 17th!) then it will be referred for court proceedings to get a judgment order.
    So no, I haven't got a claim form from an actual court. I didn't realise it may take time to do this, if that is so, then I hope my DRO goes through before that - should only be another 3 weeks. Thanks

    IF a court claim materialises, let us know and we'll tell you what to do. As it stands, it's probably still a threat, rather than an intended course of action.

I've been telling my friend what I've been doing and who to write letters to, to obtain her credit files in the hope that she can get her debt below the limit and might be able to apply for a DRO.

    One particular point that I want to question for her though, she is in arrears with her Council Tax, would that be able to be included as I thought it would be but she thinks it wouldn't - who's right?

    What can be included in a DRO please.

    Yes, council tax arrears can be included. I would strongly recommend she get some further advice before deciding for certain about which route to take though as it may be there's amore suitable option available.

    my details regarding my DRO are now showing up on the Insolvency Service website as of yesterday - 20th April. What happens next? My bank account is currently still active (£300 overdraft was included as one of my debts) Will my other creditors be notified or when they start ringing/writing do I tell them and give them the case no?

    The creditors that are included on the DRO will be notified as they need to be given a chance to argue it. Any creditors that weren't included in the DRO you are still liable for, is this what you mean by other creditors? If any credit that was included in the DRO continues to chase you for payment then give them the DRO number and this should stop any further action. If it doesn't then you should report them for harassment and chasing a debt which is included in a DRO.
