Sold a Ps2 on ebay end of Nov - now buyer is claiming ut is faulty?

  • i had a couple of original ps2's do that,

draw would only shut half way, or open half way.

the fault was caused, by my kids being rough !!
with the disc tray fully open, they tried to ram it shut , or the disc tray got bent up or down, in one case my bairn, stood on the disc tray whilst open,
the disc tray pops out of the gears, which open close it.
i took the ps2 to bits, fixed them in 10 mins !

i'm not an expert, but would have thought the fault that has developed, is a fault that would happen with the item being actually used. Not in transit.
the disc tray needs to be actually open, to then pop out of the gears.

he clearly states, "the item did work...................!!!!!!!!!"

    i interpret that as:

was working fine, when HE RECEIVED IT, now the disc tray only opens half way.
i suspect they broke it, or kids broke it.

again: sadly, the second hand Ps2 you sold him had no warranty.and was sold as seen. However you stated it worked on the ebay auction, so MUST have worked when he received the item,
It clearly did work, he left positive feedback, and he now states "it did work..."

sadly 4 weeks later, it now does'nt work. Sadly not your problem, especially as it seem's they may have broke it.

basically message him back reiterating them points !!!!!!!
if he opens a paypal dispute, so be it.......take your chance.let paypal decide.

bear in mind he only has 45 days from puchase to open a dispute, after that, he cant do anything.
he may/ maynot, be aware of that !!!!!!
maybe try and stall him, has been 32 days now .
stall him for 13 more days, say u'll message him after newyear, and we'll get it sorted, send it back etc etc, then after new year say i'll book a courier to pick it up, then wait for him to get back asking when courier is coming, say in a few days, then a few more days , its coming tomorrow, damm courier never showed, i'll ring them again re-organise.
Try and get another 13 days.

An interesting thread to read - I've had a similar thing happen regarding guitar hero 2 - except in my case the auction ended over the 45 days.
Both paypal & ebay sided with me - I haven't responded to the buyers email as I have no inclination to get drawn into a war of words with him.

How much did it sell for, and what method of delivery did you use? If you used Special Delivery then you should be able to make a claim for damage in transit from RM and then you can refund the buyer, that way everyone is happy.

Claims for damage en route are notoriously difficult to prove. RM will inspect all the wrapping, see how the damage occured and only pay out if the packaging looks like it was damaged en route, maybe by a machine mulfunction.

Things sent special are not automatically covered against any sort of breakage, it's all to do with adequate wrapping and 'fault'.

I've never had any problems with payouts, I just fill in the form and they post me a cheque. I've never been asked to send packaging or anything like that, even when I claimed for a broken digital camcorder

  • It says on royal mail site it is taking 3months for claims to go through. And just out of interest who claims the receiver or sender?

It can be either, on the form there is a box to tick that states which you are, but with eBay it would be better for the seller to claim

says on there RM site: All the damaged packaging and contents must be retained and presented to Royal Mail upon request.Claims must be submitted within 12 months of posting.

Not sure its fair claiming with RM at the moment as buyer hasnt stated item got damaged in post.
