    'Consumer' is a term that relates to ANYONE that consumes (or uses) the good produced. Therefore, I can reasonably expect when giving items to my mum that she will use (or consume) them.

    To be a consumer does not assume that one has paid for the goods, simply that they have used/are intending to use them. Therefore, anything I make that someone uses is a 'consumer good'.

    The issue of enforcement is not my concern. It may be difficult to enforce the law that I cannot smoke cannabis in my own home but that does not make it ok to break the law.

    I have spoken at length with my Trading Standards officer regarding this and her take is the same as mine - to make cosmetic products to give as gifts is illegal.

    As I said before, whether it is sold or gifted does not make it any less likely to cause serious problems for the consumer if not composed correctly and the only way the law can be persuaded it IS composed correctly is by following the guidelines of the cosmetics directive.

    Regarding the whole giving cosmetic products as gifts, whilst Kevie I can emphasis with your plight it seems crazy that should I make bath bombs out of natural ingredients and then give them to even my boyfriend this is then deemed illegal. The whole purpose of this string is crafting for christmas, making presents for loved ones therefore to expect me to pay £150 (I think thats what you said in a previous post) to then be able to make only one type of toiletry is kinda crazy and I think it would be a very sad world if he then shopped me to the police after I'd put in so much thought and care. I'd quite happily be taken to the police station for questioning on this and look at them in bafflement and amazment that they would waste valuable time on me making a face scrub for my mum, then I'd sell my story to the sun and make my fortunes ;-)
    I agree that you can cause harm to others through the misuse of certain ingredients but some of the receipes used have been passed down through the generations and involve little more than some cooking ingredients and lemon.
    I personally think that this forum is meant to be one about putting time and effort into presents for loved ones and therefore I will not be bogged down by the potential illegality of my acts of love.

    It is not for me to judge whether or not you should or should not be doing something. I simply posted to inform some people of the law which they may or may not have been aware of.

    Yes you are right that this forum is about putting time and effort into presents for loved ones but it is also about making sure that people are aware of the implications of what they are doing/making.

    At the end of the day, it is up to you. I was TRYING to be helpful by pointing out the law on this subject but I know that some people do not like my help so I will leave this subject to lie where it is.

    Case closed.

    Thanks kevie, we do appriecate you taking the time to outline it, as you have mentioned it so many times now the legal aspects of making our own soaps etc on few threads, I tend agree with you it would be better to close it now, but thank you for pointing out the legal aspects of it for anyone who wises to sell their stuff.

    I normally pop a cheque in for the older grandchildren and my two sons -usually hidden among the bits and pieces so that have to have a bit of a hunt for it...........be nice if when they did find it, it was a bit more impressive looking.
    Oh lor.......something else on the 'stuff to do' list.........just when I thought I was almost there:rotfl:

    Please don't take it the wrong way. Thanks for pointing me (us) in the direction of the document and thank you for taking the time to expand upon your point. :beer:

    I'm a philosophy student with a grounding in medical and legal ethics and so when faced with a document I read it and want to establish it's relevance. My bad if I sometime come accross as contry and difficult (my mother in law keeps insiting that I'm just direct :rolleyes:)

    If you don't mind I'll post the response from the CTPA and from consumerdirect.gov (whom I emailed as well on the basis that I'm more likely to get a response from them) because I think it would be useful for there to be actual statement relating to the position of either of these bodies as opposed to anacdotal accounts and opinions.

    Until either of those things arrives (assuming people agree that they're worth posting somewhere - not necessaraly in this thread mind you) on with the christmas planning. :j
