    Hi Soolin,

    He did pay via paypal, is there anything I can do to help myself against his false claim?

    If he does a fraudulent chargeback for item not received then the only way you can stop that chargeback is by refunding him in full or proving delivery by an online trackable method 'allowed' by paypal.

    However, if he does a claim for item not as described then paypal could go either way with their decision, but as soon as the chargeback is made your paypal account will be frozen anyway which is a pain.

    Oh god what a nightmare! Is it worth me pre-empting his move and getting in touch with paypal to explain that a dispute has arisen?

    As the dispute is about numbers delivered rather than not delivered at all, can paypal go along with the fraudulent chargeback without even talking to us.

    This feels like blackmail, it really is the last time I use ebay, it would have been far simpler to have just taken the sims to one of her ex phone shop competitors!

    lush-walrus, it isn't any good talking to paypal, their rules say that a chargeback made for non delivery can only be settled in certain ways...I'm not sure if anyone has ever suceeded in stopping a chargeback by producing emails from a buyer confirming delivery. I would have thought it doubtful as otherwise scammers would be exploiting that loophole by producing fraudulent emails from buyers claiming item has been received, or something (does that make sense? I'm always thinking of the angle that some scammers could exploit). Unfortunately by having such stringent rules to stop scammers it means that genuine sellers like you can often fall foul of the system.

    It really depends on what chargeback, if any is made. If it is a straightforward fraudulent claim that no cards were received you will lose. However, if they claim only partial receipt then it could go either way.

    However, the buyer might not bother with any claim as he must know the odds are only evens of him winning. ALso if he does claim and get a full refund, you can actually do a NPB against him..so keep that one up your sleeve.

    Thanks Soo, You have sooooo much knowledge, I wish I had just asked how to sell them before I put them on there now! Oh well live and learn, I can see what you are saying regarding paypal, lets just hope its all empty threats and it comes to an end soon. He hasnt mentioned anything to do with paypal yet, only reporting me to ebay but I guess it will all circle around to the same end result.

    Still no reply from him, but I guess Ive made our position clear and if he has actioned something himself then he will just wait for that. Only time will tell now I guess!

    lush walrus you might find he will just give up once he realises he has a fight on his hand.

    It wasn't really nice of me to suggest he might go for a fraudulent claim, sometimes my paranoia gets the better of me, so if we assume he makes only a claim for some items lost it might just not be worth his time and effort.

    He must also be aware that you can leave feedback, and a well worded neg from you (if it came to it) suggesting that he tried to claim for items that were delivered might hurt him more than the monetary loss.

    I would leave this with him now as you might find you hear nothing else. Don't leave feedback unless he does, sometimes no feedback is the best move.

    I know thats how I feel!

    His feedback is pretty good, 200 odd positives over the past 12 months one negative, 2 neutral and 2 mutually removed.

    The thing I did notice though, was that he deals a lot with people with lots of experience, and the 2 neutral and 1 negative were from people who seem to be a simular level of experience to me, ie 2 sales or slightly more.

    So I dont know if I am now becoming paranoid, but I couldnt help but wonder if he just gives hassle to new people. Like I say I could be getting paranoid, just seems odd that new people are the ones he has problems with!


    And Soo, dont worry about scaring me, I would rather be aware of the worst scenario than the best. Not that by the sounds of it it will help much if it comes to it, but at least I know and am not going to potentially get a scary shock. If it wasnt for the fact that I hate people trying to pull the wool over my eyes, and the fact that I would hate to encourage someone to lie and do things such as this, I would probably just give in and give him some money back. But its a bit like not reporting a crime really, if I let it go it will just give him the confidence to go out there and do it again.

    I guess there is always a chance that he has made a genuine mistake, as he has said that he buys sim cards day in day out, and maybe they have all become mixed together. But its different for us, they were all we had and was ex stock from an ex shop that we decided ebay might be the easiest way to get rid of, how wrong can you be!!

    lush walrus - what was the final outcome, or is it unresolved?

    I'm not new to eBay but have just encountered a similar thing for the first time. I'm a bit non-plussed because it feels like my word against the buyers and therefore stalemate.

    Its all still outstanding, the OP doesnt seem to have taken it any further regardless of the threat I received. He hasnt left any feedback as of yet either. I did receive a reply from paypal basically stating that should anything arise from the situation, ie should he take it further then it will be very difficult for me to prove and paypal will more likely than not side with the OP.

    Seems very unfair to me to assume that in all cases the seller is the lier, but cross fingers it all turns into nothing.

    Its such a stressful thing, I hope it turns out ok for you. Whats happened so far?

    The buyer has claimed that something is missing. I assumed the package had been tampered with but the buyer says it is in tact.

    This happened today & I have refrained from replying so far because I'm livid about what is being implied. Thought I'd have a looksee on here & let my temper cool before I reply :)
