    Hi,
I'm going to appeal against a parking ticket I rec'd on Sat. Apparentely it was failiure to display but the ticket was printed an hour after mine was displayed. Maybe it fell off?

Anyway, should I send the original parking permit and PCN to the council for this purpose with the informal letter or will they want the originals?

    Thanks in advance.
  • Never send the originals, always copies--you may need them at adjudication if there are discrepancies.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • I was just fined £320 for parking for 14 minutes in a private car park. Hands up, it was a dumb thing to do but immediate clamp and arrangement of removal seems ridiculous. I am devestated as that is a massive amount of money to me. I've written to them and I know it'll fail. Any ideas? Surely there has to be a limit for charges?

    No limit has been set.

The SIA, gov etc don't want to know

Take them to the small claims track of the County Court; q=uite a few people on here have done this. Search around in the board and you'll see how easy it is to do.

    Updates - feedback please?

I have two parking fines that I am appealing both of which are described in previous threads.

Tesco/UKPC (where I parked in a disabled place without a permit because all of the parent and child spaces were taken, and some definitely did not have children on board): I revisited the car park and noted that there are signs that warn against parking for more than 3 hours, parking in designated bays only (not on yellow lines etc.), disabled badges required for disabled bays, and parents with children only allowed in the parent and child spaces. Whilst I was there a manager was in the doorway, who I queried about the policy, particularly the fact that the parking attendant was stood talking to a taxi driver who was parked on double yellow lines! The manager agreed that this was wrong, and whilst asking the attendant to move the driver (which they did not because "it wasn't hurting"), they aslo questioned why the attendant had not booked the drivers without children in the P&C bays. The attendant advised that this was not company policy, which the manager challenged and was gobsmacked when told that this was Tesco company policy. Appeal has been escalated - watch this space.

Euro Car Parks - copies of signs received but not a map showing where signs are located (this has been requested). I was fined as a "stadium user", but I have receipts timed and dated proving I shopped in the retail outlets, so my basic defence is that I was shopping? There is a restriction of 2 hours in the car park, but this is not why I have been fined, although I did stay for over 3 hours. This time limit is very short as there are lots of stores and it would be quite easy to spend 3 or 4 hours there, so I guess Christmas shoppers should beware.

There is no sign visible at the entry (that I used) into the car park, or between the entry and the space I used (50 yards), or visible from this space, or from any part of the route from the entry to the space - the only obvious sign is a no lorry parking sign. The sign that is unreadable near the entry which is side on to the traffic facing the roadside is Terms and Conditions, and even the image provided by Euro Car Parks is unreadable, so I don't know what the T's and C's are.

I know the advice is to ignore etc., but these are both plain wrong, and need to be fought directly.

If you know what the advice is, why are you posting on here for asking for advice that is different to the correct advice??

The advice is - unenforceable, ignore, blah, blah; so I'm not sure what else you want to hear??

You say 'plain wrong, and need to be fought directly'.

It won't go to court as the PPC would just drop it.

So you'll never be able to prove them 'plain wrong'; and even if you could the PPCs wouldn't do anything about it - so nothing would change.

All in all, I'd say you're wasting your time tilting at windmills.

Sorry if that sounds a bit harsh, it's not meant to...
  • Appealing is not fighting them its just confirming they have got the right person and they'll just try harder to frighten you into paying.

  • In got a Euro Catrpark ticket on 31st july because my ticket was face down (I serioulsy think it may have flipped in the wind when I closed my door!!!) So I appealed saying what had happened and enclosed a copy of my ticket stating I had paid for 2 hours during the time I was fined! I have received a letter today stating "the ticket is valid" and they have enclosed a photocopy of my car reg and the upside down ticket!!

I am furious as though it was upside down I HAD paid for the time (proved by a copy of the carpark ticket!!)

    Should I ignore?????

Might be too late now as you've confirmed that it was you driving [or maybe you haven't??]

SO in theory they could take action,...but ask yourself how likely is that to happen, even if they do have proof that it was you [ie your appeal letter]

    I'd be tempted to ignore

Shame you hadn't seen this thread etc before you responded/appealed....

In future, ignore all PPC 'tickets/invoices.

Since the invoices are pretty much unenforceable does anyone on this thread have a policy of NEVER buying tickets of any sort in private car parks eg NCP, Tesco, motorway service stations??
