Accident & Injury: Compensation from TFL . . .

    she may be able to claim compensation as the bus driver stopped and let her out at an inappropriate place - which I'm pretty sure they aren't supposed to do.

    i do agree though that this was a pure accident and this compensation culture is ridiculous (i should know - i'm a claims handler!). at the end of the day the injuries weren't serious but some people want to claim for everything they can get.

  • Sounds like no-one's innocent here?

    The bus driver should have stopped at the right stop, but did make amends by stopping asap rather than continuing to the next stop.

    Your sister should have looked before stepping off of the bus (I'm assuming it must have stopped a fair way from the kerb?)

    The cyclist should not have attempted to cycle between a stopped/stopping bus and the kerb - they should have overtaken on the outside.

    I think you should be thankful that her injuries are not too severe and chalk it down to experience - this really was "an accident".
  • British armed forces in Asia are dying and having their legs blown off or suffering serious burns and getting just a few thousand for some of their injuries. Your sister fails to looks where she is going and causes minor damage to herself and a bike and you are looking for compensation for her? You sound like one of those people who post on the benefits thread always asking for their rights. I'm not usually rude to people on public forums but for once your post has really annoyed my usual tolerant self. I suggest you thank God that your sister is alive, has all her limbs and then concentrate your energies on something more important. Sorry but I can't stand compensation culture for minor events.

    Did she sustain permanent damage? Did any of her injuries cause her to be unable to work?
    As you say she sustained "minor injuries and bruises" then I am guessing not which begs the question... why are you even asking if she should get compensation?
    whether the bus driver, cyclist or your sister was at fault the only one suffering any serious loss was in fact the cyclist.

    well i think the OP has most likely been scared away by all the bashing!

    i know everyone hates the compensation culture (well almost everyone) but at the end of the day if you have been hurt by someone elses negligence (even if they were only partly to blame) then you are entitled to claim for any personal injury suffered, thats the way our legal system is.

    I agree with you, everyone was, to coin a phrase "at fault" in this accident.

    Even the Health and Safety people (bless 'em), don't use the word "accident" any more because they believe that "accident" infers that no one was to blame, and there is always a reason why incidents happen.

    I am sorry to hear about your sister, but sounds like she got off lightly really. I was hit by a car when I was 15, partly his fault for speeding and not looking and partly my fault for not paying attention and not looking - I still suffer from back pain occasionally 20 years+ on, but would not have dreamt of going after compensation - I played a part in the "accident".

    Sounds like the cyclist was undertaking the bus, so at fault (but perhaps didn't anticipate the bus stopping if it wasn't a bus stop), and your sister didn't look as she stepped off the bus, so also at fault.

    Your sister could sue the cyclist using one of these ambulance chaser companies, and the cyclist could sue your sister.

    This would probably end up with both of them out of pocket, and some cheesy solicitors with a big fat christmas bonus!!

    It was an accident - accidents happen. Why are people obsessed with sueing each other?? We're not american!

  • Thanks to the few who understood the OP and made useful replies.

    In response to the others and for extra clarification, the cyclist was riding on the 'road' near to the kerb. Everyone at the scene blamed the bus driver and her details were taken for complaints to TFL.

    It's true that my sister should've looked both ways before boarding off and as such it may be said that she is 'partially' to blame. However, to suggest that she is 'completely' to blame is quite irrational if one has understood anything about the circumstances.

    Thank God she is now recovering but for a couple of days she wasn't able to do much and still suffers from some pain to the head and bones.

    However, what we, as well as witnesses on the bus, are unhappy about is the fact that the bus driver did not stop at a designated stopping area. This especially combined with the fact that it was dark and visibility was reduced so that it was possible to miss spotting anything coming at you even if you looked. As far as I'm aware the bus driver is not permitted to let passengers off anywhere other than the bus stop. And this is the gist of it.

    So what did your sister want when she told the bus driver that she wanted to get off at the last stop (the one that the driver didn't stop at)?

    I'm sure she would have been complaining if the driver had told her to get off at the next stop and walk!
