Accident & Injury: Compensation from TFL . . .
Hi All,
I was wondering whether I could get some advice on this great forum. Here's the situation:
My sister (who is 16 y.o) was heading back home from the shops on the bus one early evening last week. Before reaching her stop she pressed the bell, as one would, but the driver never stopped. My sister went to remind her, the driver, and only then did she stop - well away past the bus stop. As she stepped to get out of the bus she collided with a cyclist travelling along the same path on the road near the pavement. She was rushed to hospital having sustained some minor injuries and bruises and the man's cycle was damaged. Thankfully she is now better but suffering from mild pain to the side of the head, although could've been much worse.
1) Is she eligible to claim compensation from TFL for the bus driver's errors which resulted in this accident?
2) What information/evidence is she likely to need to present?
3) Which agency would you recommend we approach to make a claim?

i would of thought the cyclist was entiteld to something towards repairing his bike ...would he sue your sister ?
Maybe the bus driver didnt hear the bell ? maybe it wasnt pressed hard enough ?
I dont understand why would your sister need compensation ? wasnt it just an accident ?

the bus driver has a light come on in the cab so even if they didn't hear the bell they have a notification of the request.
it might be worth looking on the tfl website at the complaints procedure and see if there is anything there relating to this.

I'd blame the cyclist - it's illegal to ride on the pavement.

Cyclist was not on the pavement:cyclist travelling along the same path on the road near the pavement
I agree - you sister should have looked if there is anything coming, but I would also say she should complain to TFL. Although, drivers 'forget' to stop are nothing surprising... They are often daydream while driving...Spring into Spring 2015 - 0.7/12lb0 -
If I stepped off the pavement into the path of a cyclist, it would be my fault for not looking.

She stepped off the bus without looking!! She could have done that at the proper stop.
The only person who has a right to moan, or seek compensation, from what you say, is the bike rider!
The driver didn't respond for whatever reason but it was a small error and would not have caused any issue at all had your sister been more careful! Perhaps they had to pay particular attention to the road at that point? Perhaps there was a wally like your sister who stepped into the road and they were concentrating on avoiding them?
Your sister is 16 and old enough to take responsibility for her actions. Tell her to think herself lucky and get on with her life.

I thought the cyclist was on the pathway? Im not sure if the cyclist was at fault. But if the cyclist shouldnt have been there then the op's sister should go for compensation. Do you have the cyclists details? And the bus drivers details?0

I read that as cyclist was on pavement. Perhaps hte OP could clarify?

The op said the cyclist was on the path near the road. After reading the post again..as the cyclist was on the road (i believe). I dont think compensation should be gone for, as it sounds like the sister didnt look and walked into the cyclists path.0
