    Hi everyone

    Just received a horrible letter from Irwin Mitchell Recoveries who state they are acting on behalf of RBS to recover monies owed and have given me 14 days to pay in full - £15,648.39 :rotfl:otherwise they would commence further action to recover the amount outstanding which may include seeking a Money Judgement through the County Court and applying for a Charging Order against my property.

    I have been paying RBS for 3 months on my DMP - why do I suddenly get this letter out of the blue?

    Anybody had any experience with this firm and are they likely to proceed with their threat?

    Hi

    My husband has a loan with them and yes they will follow through with their threats. We got a ccj to pay in installments and have never defaulted on this but they did however reapply to the court to have the installment overturned from an installment order to a forethwith so they could apply for a charging order. We went to the hearing and the judge has said the installment order will remain but said they could apply for a charging order. He did say that it is not guaranteed they will get one but even if they do it will not be used to force the sale of our house.

    Hi Hopefull, how come they got a ccj against you? Were you in a dmp with them or not?

    Hiya,

    It is vital you request a copy of the original credit agreement (CCA request) to see if it is a valid agreement. If it isn't they should not be able to legally persue the debt.

    A creditor has 12 working days to provide you with the requested document otherwise the account becomes automatically disputed and enforcement action is not permitted.

    You need to send a £1 fee with your request.

    This could be a very long and winding road for you, but the authorities are finally clamping down on creditors who ignore the rules and continue to persue, especially DCA's.

    Have a look through the following thread for more information. They are lots of clever people who post on there who will assist you with template letters etc.

    got home today to a letter from Barclays regarding the offer of payment for my overdraft, basically saying that with the offer i made (through dmp with cccs) it would take too long to pay off and they would be passing this on and someone would contact me - just wondered if anyone had any experience of Barclays Overdrafts - will it be Mercers or is that just Barclaycard??

    Anyway just wanted to waffle on how I am getting on and hope it inspires some of you lot to start reclaiming your own ppi and charges back. It's so worth it when you see you have won and a small amount taken off the debt total!

    me im well, just tackling each of the creditors as they didnt really help me when i tried to set up pro rata payments and then whooooooooo after i asked for my cca copy they really turned up the phone calls and then it was enough is enough

    so im learning every day something new and its such an eye opener, that it does not scare me any more

    I haven't got that far with them yet.. I'm still around month one.. well.. about to make 2nd payment.
    Their reply to my initial letter/offer etc.. was a 'Quite nice' letter .. AND a 'Default Notice' :rolleyes::rotfl:

    Anyhooo.. they told me to wait until their DC contacts me.

    I was thinking that was okay... maybe not then.. haha! _pale_

    Hi Crafty,

    Barclays have done this with all my accounts - overdraft and 2 x loans. I didn't actually think that 5 years was that long as my loans still have 5 years to run but I guess its potentially 5 years of lost interest. It wouldn't be 5 years if the single premium ppi was removed but that is something I will deal with once my DMP is up and running.

    I phoned up Barclyas when I got the letter and they just said that it will be passed on to a DCA but were unable to say who and as the 14days isn't up I havent hearnt anything back yet!

    Just something to be aware of, when you get the termination notice, this will proabably arrive in a few days, the account doesn't close so will still accept payment, hence all my salary problems last week.

    For, the two loans I have only had these two initial letters and nothing else so will just have to wait and see.
