Hiya,
It is vital you request a copy of the original credit agreement (CCA request) to see if it is a valid agreement. If it isn't they should not be able to legally persue the debt.
A creditor has 12 working days to provide you with the requested document otherwise the account becomes automatically disputed and enforcement action is not permitted.
You need to send a £1 fee with your request.
This could be a very long and winding road for you, but the authorities are finally clamping down on creditors who ignore the rules and continue to persue, especially DCA's.
Have a look through the following thread for more information. They are lots of clever people who post on there who will assist you with template letters etc.

Cocker - Thanks for your reply but not sure this will help to be honest - this was a last chance consolidation loan with RBS - you know the one they persuade you to take out to replace loans you have with them at a lower interest rate but you are in arrears with????? - so it is pretty recent and I guess they closed the hole in the credit agreement didn’t they?DMP mutual support thread member: 256

Oo My wages DID go into the my new account .. phew!!.. I missed swapping it over last month by a whisker and had to wait.

got home today to a letter from Barclays regarding the offer of payment for my overdraft, basically saying that with the offer i made (through dmp with cccs) it would take too long to pay off and they would be passing this on and someone would contact me - just wondered if anyone had any experience of Barclays Overdrafts - will it be Mercers or is that just Barclaycard??
I got this then Payplan told me they had accepted so reckon it is hot air.

I've finally had it with HSBC!! After weeks of constant calls from HSBC, I finally answered the phone again last night.... wish I hadn't bothered really.
The guy at the end of the phone, frankly sounded old enough to be my son (sorry, shouldn't be ageist:o) and had the intellect of well below that. After the usual 'can you make a payment today' 'nope' conversation he decided to go through my budget, which basically consisted of me giving him the figures CCCS had already sent him, at the end of which he asked again 'so you have no money to make a payment today' (errrrr hellooooooo?!!!! you've just seen my budget - every penny is accounted for!!!!!).
He asked in a very stroppy teenage manner (told you he was young!), wasn't I able to do any overtime at work!!! Followed by, are you able to borrow money off family or friends to pay off the outstanding amount.
:mad: I told him 'no' to both, and that he was going against OFT guidelines by encouraging me to borrow more to pay off an original debt. To which he replied - I was only asking.... :mad:
Anyway, after 20 minutes of this rubbish, including almost begging me to take out a managed loan, he finally realised that you can't get blood out of a stone and said he'd put my account 'on hold'. Honestly, HSBC say in their literature that they will work with debt agencies such as CCCS if asked to, and when you do ask them to contact CCCS they say, 'oh we don't accept their DMPs, we work out our own figures'........
I have now deleted all my telephone nos from the internet banking site (they have my postal/e-mail addresses if they want to contact me), and home is now a haven of peace, tranquility and no unwanted phone calls!!
OK, rant over.... How's everyone else finding HSBC? Haven't seen MRSG2B on here for a while - she was my HSBC-bashing pal!!

Yeah, I've had the letter that tells me that my loan with them is in default and they sent that shiny double-sided leaflet that all my creditors seem to be sending as I've been on DMP for 2 months, and they tend to take action after 2 (full) missed payments, as they've only had the reduced amount. Does that make sense? As far as I can gather from this site, this is a normal step in the whole process, it shows that the original contract terms to pay the minimum have been broken and (potentially) allows them to take it to court if necessary (praying that it doesn't happen).

Thanks Devongirl, this isn't the proper default letter though is it? and am I right in thinking they cant take me to court until I have my default letter which has to be within 14 days from the date I receive the letter. Thanks in advanceLBM MAY 2009 :T
