    Hiya i am on a few of my debts, one getting £30 over the min payment, Halifax are the only ones who now say my account is in good order and have started applying interest again...im not too worried about this as they still dont contact me and the ballance is still going down.
    4 of my creditors will be gone in May so the Halifax will then get even more so ballance will go down fast ever though interest has started to be applied again.

  • Morning everyone hope you are all ok

    Just to update - I spoke with a lovely guy at the CCCS yesterday after plucking up the courage to speak to them. They were fantastic - agreed to up my shopping budget and also advised me to up clothing budget too so that I had money to cover for expenses for girls who stay with me every weekend (court order). I also asked them about what I should do if I find I have extra money left at end of month and they advised me near enough to the word exactly what DLB on this forum told me to do (Big Thanks DLB - Donna). CCCS told me to put the money to one side and if after a few months I still found that I had extra money then I could either pay it over to my DMP or keep it for emergencies.

    I also asked them about starting the DMP in march as I was expecting my winter electric and gas bills to land on my mat any day and I would like to get them paid so that I can then set up DDR's for all future months and CCCS said yep no problem thats the right thing to do - you must pay all your essential priority bills first. So my DMP is to begin in March.


    After catching up on this thread I have decided that if I can budget better and have money left over then I am gonna keep half for emergencies and half to go in a pot for F&F settlements as I think it will be a great motivation seeing creditors being removed from the list if they agree to F&F.

    Anyway thats a while off yet -got to see if I can budget better. Things are off to a good start. Did a shop online with saindburys last week - it was delivered Friday 9th January and I bought loads of their cheapo range (sorry forgot name) and so far everything has been lovely and I got enough stuff for 2 weeks food excluding fresh milk bread and fruit and veg for the 2nd week - and only spent £ 65 this is a great improvement as I normally spend £50 per week I also bought baby milk and cleaning products too so I think I did really well but I am gonna go over to the OS boards and see if I can improve on this anymore.

    Off to make a cuppa - get dressed and off out to post my DMP (didnt manage to post it yesterday was feeling dreadful - comes with ther territory of having marfans).

    Do you have an idea of a Debt Free Date yet ?

    Ours is supposed to be 2016 but were aiming to half that if the FnF offerings are accepted.

  • Hi Everyone,

    Need some advice please.

    After 5 months nearly all my creditors have accepted my dmp offers accept, Barclaycard, they have passed it to mercers, (In house) and they will not accept my offer of £2.34, this is the figure payplan have given themas they work out who gets what etc, anyway, they want £5 per month or they will be sending someone round to my house....I really dont want this for the sake of an extra £2.66, i emailed payplan to say shall i just pay the extra £2.66, they say no, spoke to mercers they say i can pay them directly the difference....Payplan say that if my other creditors find out they can take further action....I have looked on my credit report and it doesnt say who gets what amount.....Can anyone help please???????

    Pink Sparkle, dont worry. From what I have been reading, and the notes I have made, if they do send someone around you can tell them to get lost !.

    I had a letter from AEGIS (MBNA's muscle) and did some research. I found this small thread. take a look ..

    The absolute worst that can happen as far as I understand is IF they donot accept the debt and the repayment, you ask them to register a formal default on the debt. This is legally binding and means the interest on the debt has to stop. Ok, it will result in a court appearance, but if you have the supporting documentation to illustrate your on a DMP, the court can see you are tryign to repay yoru debts. Even if you get a CCJ, they will only legalise the repayment ammount or in some cases, lower it slightly to adjust for interest or cost of living.
    You only really get into legal issues and then collections people with enforceable rights of access to your home if you default on the courts judgement.

    Secondly, PayPlan will have constructed an illustration of your household income and outgoings and this will have been sent to your creditors when the DMP was started. This I believe is all part of the DMP proccess. The creditors have a right to ask for updated statement of earnings and plans.

    DONOT offer one creditor more than the other, or bolster outside deals paying one creditor more because this can de-stabalise the DMP. and will certainly P*55 the other creditors off.
    If you do speak to the debt collections agency again, just tell them the DMP has been constructed to ensure all creditors are treated equally and you cannot afford to pay them an increased ammount. Then, if they want to go the court route (to which they are entitled I believe) its up to them. but they then have to convince the court as to why they want more money where as you have the SoE and the budget plans to re-enforce your standpoint)

    I think what Ive typed is all factually correct. no doub t someone will correct me if im wrong. But this is my understandings based on the research I undertook before going down the DMP route

    O forgot to add, use the justabank login to see the breakdown of what your creditors are getting and the balances on the debt so far. This is calculated on a pro-rata basis. If you can pay more into your DMP then the money will be equally divided amongst all creditors anyway.

    I'm still here just about, but still signed off work with this awful virus and feeling quite low.

    Hi to all the new members! You will get there and as many others have said after a few months, and using information from here you will feel stronger and better informed about everything and the kitchen sink regarding DMP's. This site has been invaluable to me and it's very reassuring knowing that you can come here any time and ask a question (no matter how big or small) and that someone will answer pretty quick.

    Toffee-Penny that's great news about the ppi claims! It makes me feel a little more positive- Just wanted to ask, as am still getting letters from creditors about arreas and asking for that amount etc even though I have been paying through CCCS now- what I wondered should I send letters to all creditors again stating my situation but also in with this letter can I ask about reclaiming charges etc? If so are there any templates out there or what has everyone used before? Just didn't know whether to give this a go all in one to save on the postage or whether to keep it seperate?

    How will any of my other creditors kmopw if i am paying an extra £2.66 a month to mercers???

    Pinksparkle..this is scare tactics..stick with you dmp and let them help you deal with this, payments are done on a pro rata system and if it does go to court (this would happen before anyone appeared at your door) the court will see you havekept them informed of what you can afford to pay and that all your creditors are being treat equally and would enforce the payment at the amount you have offered...and you know what they know this and threating to send people to your door if there way of trying to get more money as they wouldnt take it to court as they know the judge would be fuming at them, and it would cost them money to do so and they would still end up with the same payment.

    Stay strong..they will try every trick in the book to get more money stick to your guns and you will be fine.

    Well done Marfan...you sound so much more positive...big pat on the back to you for taking it by the horns and starting to work it out.

    Hi eveyone
    I have a question, I don't really get statements any more, RBS send them occasionally (which is how I found out they were still charging interest though they had said they would stop) but have not had anything since well before christmas off most of them.
    Thing is how do I find out an up to date balance? Is the only way to phone them? Was trying to avoid this for obvious reasons.
    CCCS said at my last review I should inform them of current balances.
    I don't have online banking facilities with any of them.
    Sorry if this is a stupid question. Wondered what everyone else did.
