Evening all!
Just one letter today.... M&S have refused my DMP as the payments aren't big enough. Thats both MBNA and M&S now.
I'm on a low start DMP so wondered if anyone else who is also on low start has had any of their creditors accept the low payments?

Good evening
We're on a low start DMP and have had NR , M&S and Tesco loans all ACCEPT our offers, MBNA being a bit cheeky at the mo, just waiting on Tesco CC, Barclaycard CC and HSBC O/D at the moment.
Stay positive, it'll all come good in the end StOlli!;)

M&S accepted after about 5 months. They stopped interest pretty soonish though. I was originally on a 20 year plan (could be classed a low start?). Ironically after 4 months I doubled my payments so they had to send out another letter of acceptance...
MBNA were awkward, to start (they passed to RMA who were awkward - the actual MBNA weren't that bad I guess), but they've just sold off my debt after offering me approx 35% fnf.DMP mutual support thread No: 2430 -
hi everyone - can everyone with experience with Northern Rock let me know what has happened with them. We started our DMP in December and Northern Rock have kept fairly quiet until today - hubby and I have both received default notices (it is a joint account but I guess they have to let us both know individually). I phoned them to remind them about the DMP, but the guy just said that if we didn't pay the outstanding amount, they'd send us a demand for the whole amount (just over £25k) and then if we didn't pay that they would have to keep on going with the legal action until it got to court stage. I don't know how much of this is empty threats or will they really go all the way? I would just like to know how far Northern Rock have taken it with people and also -for those people that northern rock accepted.. what happened first, were there the threats or did they accept straight away? I am so scared now. My husband's work is looking at saving money at the mo and talking about pay cuts and possible redundancies - a sign of the times I know, but scary all the same. I just wish I could see a bit of light. I have been scared about NR since day 1 and hoping their silence until now was a good thing, but I am not so sure!!
Sorry about the essay! x0 -

Hiya,
Is this a loan or credit card account?
If it is either of these, have you sent Northern Rock a CCA request?
If they cant produce the appropriate paperwork, they cant take you to court to enforce the debt!
Even if they do produce any document, if your account started before April 07, then there is a good chance that the agreement would be unenforceable.
Have a look through the following thread for more info on this:

Thanks for this... I've been trying to get some money saved and knowing the kinda figure I MAY get offered for fnf is good as it gives me something to aim for.... eBay here I come again! :rotfl:Light Bulb Moment 4th January 2009 :eek:Started DMP 1st April 2009 :ADMP mutual support thread member: 267 :j0 -

Hiya Cocker,
This wont come under the CCA 1974 if the original amount was over £25k which I would assume it was. They did change the Act in 2006 to cover this so it depends whether its a loan etc & when it was taken out.:j DMP mutual support thread member - 135:j0 -
Hi, can some one tell me if it is better to send a cca request or a sar request to a cc company, I havent missed any payments yet, so have no charges to reclaim but I have read somewhere that cca requests dont always come back with the right information. Also would they still accept the request if I print my name instead of signing because i've also read cases of them copying your signature. Thanks for any help.0

Hi,
It's always better to do an SAR request but the obvious downside is the cost (SAR= £10, CCA= £1). Stick to printing your signature & certainly don't give them your actual one, as some firms have certainly added signatures to paperwork.:j DMP mutual support thread member - 135:j0
