Morning everyone.

Well, after the worst nights sleep ever worrying about this flaming ccj/charging order and dreaming about bailiffs knocking down my door, I got up and decided !!!!!! them - if that's what they want to do then let them do it. But thought I would just give Triton a call to ask them why, on 28 Jan I was told the payment plan had been agreed and then 3 weeks later I was issued with court papers! Was then told that as the debt is in joint names, Incasso shouldn't have issued the court papers against me and the debt was still with Triton! Can you believe it??!?!?!? She told me to disregard the court papers and she would speak to Incasso. Of course I told her I wouldn't just disregard them until I had proper confirmation that there had been a !!!! up somewhere along the line. So I'm now sat waiting for the phone to ring so I can be told for definate that no court action will be taken. Fingers crossed!

Cheers for replying so quickly, you've put my mind at rest. I felt like I was going behind Payplans back when the man from Lloyds said about refinancing as it sounded wrong to me. I know he was just trying to get the money I owe back sooner, but I couldn't help but think that the reason i am in debt is because of refinancing offered by Lloyds in the first place and I didn't want to do it again.
I think i will leave it all to Payplan to sort once I have my review in April. Its all so stressful.
(I am going through a bit of a crap patch not just financially but private life too. My partner and I split up after 5 years, my best mate died and I just can't get focused in work, which is a pain as i'm in charge).

What a nightmare today!!!!

Bank cancelled agreed OD this am (bank I am leaving got last pay in it) because they charged interest and we went £7 over our agreed OD. had SO going out to my new bank account today which I have had to cancel and phoned Nationwide up and they have reinstated the overdraft but will take 3 days. Now I am seriousley p***ing myself as I sent a letter with a token payment to Nationwide Credit Card and I am now thinking that once they get that they will look at my current account and think uh-oh better stop that OD quick. What do you guys reckon have I time to get that money (my wages!) out ? Will it be Wednesday do you think as it is weekend tomorrow?

Sorry for ramble but Hubby has stormed out and I am sitting here in tears.

They cant legally refuse to give you your money/wages...get down the bank asap today or in the morning and tell they you wish to withdraw your daily linit of money...they can not withhold benifits or wages even if you have gone over you overdraft limit..at the very least they should have taken the `charge` from the wages and then infomed you that OD was to be stopped.

The credit card depo is seperate to the bank accounts so it will take them a while to realise the fact you have account with them too.

To anyone else changing bank accounts over....draw any money still going into the old account the day it goes in, cancel dd and find another way to pay these until new account up and running.

So as long as the CC people dont realise before Wednesday I will be ok. I will try to get the wages before then also will go in today. This is so stressful. On a lighter not my Tax creds have gone up by £60 a month so this is fab news but cant help thinking its an error as I am full time working and earn enough on my own to take me over the threshold.

This thread is so supportive and feels a lovely community.

Hi Bexxie90, did you look at the Right Of Appropriation letter or search for it on here? CCCS advised me it was the best route to go if you thought the bank were going to hold onto your money to pay their debts first.

Is it worth me doing do you reckon as bank said they will reinstate but will take 3 working days. I was just worried that CC people would get there first iykwim

Well Triton have rung me back and confirmed that Incasso shouldn't have issued the papers and a Notice of Discontinuance will be sent out today to me and the Court! I'm so glad I woke up in a stroppy mood this morning and decided to question them! They have said they will review it in 6 months so come Aug I will probably be as stressed out and scared as I was yesterday but for now I shall just live for the day!!!

Dont have time to post much i'm afraid and i'm still catching up on posts from yesterday - how good is it that its so busy on here!!!
