Usually, any refund from the CC company would be for the proportion of contract remaining - however this would only be relevant if the company goes bust - the CC company is actually jointly liable for the original contract, so you could also ask them to provide an equivalent service to that originally contracted.
Not actually true. Under Section 75 of the consumer credit law, a cc card is liable for any breach of contract whether the company has gone bust or still in business. This applies only to purchases over £100.0 -
Is there anybody who can understand the conract and can see if they are in breach of it?0

Possibly section 4.3 (as a starter)Personal Responsibility - Sad but True

You are correct of course, the credit card company is jointly liable for any breach of contract.
What I meant to say is that the situation becomes more straightforward if the company goes bust and the contracted service is withdrawn, as the the CC company is then solely responsible.
If the company is still trading, the CC company can be a useful to exert pressure upon the supplier to provide the service or goods contracted. However, if the service or goods are unsatisfactory, it can often be a more complicated and lengthy process to get a refund, as the previous poster was asking.0 -
I probably don't need to post this, but for anyone who is unaware.
This is really for people who are thinking about joining e7even - DON'T !!
That is the current update on a job that has been open since Dec 28, leaving all the people on the @bbuk realm with a connection often worse than dialup, and many still with no connection at all.at this time we are unable to confirm a time-scale for the problem to be fixed, however we will post an update once this information becomes available.
The situation is becoming very unclear. The network upgrades, due to be completed on Jan.4 are still unfinished with e7even now admitting they don't know when it will be fixed.
To re-iterate, e7even have split their network three ways.
First, keeping their old network,
Second using networking belonging to Euro1Net, a company also in Maidstone, but they deny all involvement with.
Third, using Netservices to provide the new realm @bbuk
The first two options are working fairly well, but it is this last option that is causing real concern, not just for the users, but for the future of the whole company !
E7even now appear to have no solutions to the problems with @bbuk despite moving large number of accounts there. Many accounts worked Ok before the move!
As time goes on, concern grows as to what the strategy will be.
If they were ordering something like a new BT central, then don't you think they might be eager to convey that fact?
The statements and updates released by the company are very poor, leaving everyone in the dark as to what the real problems are.
They are only sending out MACs to some people, some MACs are bouncing, and they are not replying to everyone !
The recent amnesty seems to be a strategy to lose some accounts, presumably to free up bandwidth.
The danger of that strategy is obvious. They also need to give refunds to people leaving. I believe there was a trading loss even before this decision.
We now know that a director did resign recently.
The problems now do not appear to be technical, but financial (if it really was technical, then they ought to be able to provide a better explanation after more than three weeks)
The suspicion is that they are possibly trying to merge or sell the company. Everything appears to be put on hold at the moment (specualtion is rife because communication from this company is extremely poor!)
For people already with e7even and with working connections, then all they can do is hang on and hope for the best (if they can stand the stress).
But for people considering signing up to e7even at the moment, i would say give it time. Watch this situation very closely, because there is more at stake here than just the mangled @bbuk accounts
As has already been said, even if they fixed it today and there were blistering speeds, many people would still be happy to take the amnesty and leave, simply because any trust in this company that was remaining has evaporated during this episode.0 -
Can i got to somebody to get the E7 ADSL removed from my line so i can join somebody else.
E7 have now emailed me telling that they will basically send me my MAC as and when not within the 72 hours............. well its been almost 7 days now.0 -
Tomlewis007, the answer is no. The only people who have the power to do so are either Ofcom but your complaint has to be made in writing to them & E7even followed by 3 months of investigation.
This is really hacking me off! I want my mac so I can get out & go to someone who can provide me with a service!0 -
I saw this post on the adslguide forums and thought it was a good message!

I applied for the amnesty as soon as it was offered, so far zilch! I am currently using dial in on their emergency line using the new extended user name they gave me. This does not work on bbuk, is it possible my old one works again?0
