    As mentioned, covenants & planning rules MAY be enfoceable, but will take a lot of exxort & possibly expense, for you.

    Certainly wouldn't use your own car a s another 'obstruction', either - it might get 'accidently' damaged.

    What I don't understand, is how they've a large enough driveway, to park these vehicles on. I'm assuming it has been widened, from it's original size &, if like we had to do, would be to get this approved with the local council beforehand & they needed to know, if it was to park vans/commercial vehicles on.

    You can ask the authorities, if these procedures were followed.

    Similarly, you can find out from them, what business use has been granted to the property.

  • I'd have nothing to do with them personally.

    Just deal with the council.
    Start with the planning department.

    With regards to covenants, as someone has already put. Its all very well a covenant existing but there is no way to force them to take legal action. After all, would you proceed with expensive legal action if you could sit on your hands instead?

    If you have loads of money ask a solicitor.

    It sounds like you are the selfish one here! Parking on the road "just to make a point" when you have a garage and drive that you could use. I hope that you are prepared for the consequences of your decision to complain.

  • i have just read the covenants again and it states that the parking issues etc cesces 12 months after completion of the development. the drive way is what the builder installed, it leads up to a three garages to the rear of the property, i far as i am aware nobody visits the property, i will not state what the people opposite do but there is no one working at the house apart from his wife. The vans work away from the area and only come back to park, the staff park there cars on the drive during the day which involves 2 cars. the house next to the drive is rented and the tenants there do not say anything as nor the owner who said he is a friend of the people opposite. I do not want to moan but it's not nice having to look out of the window and see the vans parked.

    How can you possibly say that you don't want to moan. That is exactly what you are doing. The fact that you do not like to see vans parked opposite is irrelevant. I don't like to see caravans parked in gardens, they do nothing for the suburban scene, but I do not go around moaning about it. If they are legally parked then that is the end of the matter as far as I am concerned.
    You should be glad to see that people still have a job. The only possible cause for complaint you might have, is the fact the fact that they are running a business from the premises, in violation of some bye-law or covenant. You say that you do not want to upset the rest of the road by getting caravans etc, removed, but you are quite happy to upset the people opposite.
    As for causing an obstruction yourself, well words fail me!
    Don't be surprised if you wake up one morning and find that your vehicle has been "accidentally" damaged by someone trying to get past it. Don't forget that being bloody minded is a game that more than one person can play.
    I can afford anything that I want.
    Just so long as I don't want much.

    · Will your home cease to be used mainly as a place to live?
    · Will your business cause a noticeable increase in traffic movements or people calling? YES
    · Will your business disturb your neighbours or cause noise or smells? YES
    · Will there be a need to park a commercial vehicle or a need for outside storage? YES
    · Will the business involve activities that are unusual in a residential area? YES
    · Will it involve people outside your household coming to work at your house? YES

    If the answer to any of the following questions is YES then a change in character or use probably will not arise, and planning permission will not be required:
    · Will the business involve a single room and primarily involve use of a telephone? NO (standing vans)
    · Will only members of the household be involved? NO (people parking cars)
    · Will there be few or no deliveries other than normal post?
    · Will there be no noise or smell?
    · Will it be low key activity and not inconvenience your neighbours?

    If you believe that planning permission is
    not required and that your business will not
    involve a change in character or use, then
    you can apply for a Certificate of
    Lawfulness.

    Its not you that has the issue. The law is there for a reason, to protect you from the nuisance. You're not moaning you're asserting your rights in law.

    what would you do if they got rid of the vans and replaced them with 4 big motorhome or 4 caravans , would that have an impact on your enjoyment of looking out of your window ?
  • I think I can post whatever is relevant to the issue. I see nowhere on this site saying it has to be positive. I tend to only post when people decide they want to be unsociable or knowalls. I could post many positive aspects re Gas or Plumbing but others here do that and are constantly belittled or called money grabbing cowboys. You have others who seem to think if they tell a poster they will get the perfect job done for peanuts it will happen.
    I fully understand this is a site dedicated to saving money but the fool here moaning about vans being parked on their own drive is only asking for it to cost them a lot of money when it all blows out of all proportion. I wonder what her husband thinks or do we have a Hyacynth Bucket BOUQUET here?
  • this was an open polite query for help....why all the unkindness...? i have similar problem my neighbours van obstrucs us al seeing oncomming traffic and has torn up the verge in a conservation area to deep mud.. its annoying to pay a premium to live in a nice area only to let someone turn it into a buisness estate.


    just to reinforce the money saving ideas of this site would include helping your house to retain its value.
