Marbles calling me - what to do?

    In the letter they say that if I do not pay the amount requested within 28 days of the letter they will pass my default details onto a credit reference agency. So I don't think they have done it yet. I can scan a copy of the letter if you want?

    hi

    if they do put the default on your credit files you can complain to the FOS on the grounds you state in regard to the banking code. ie the debt is in dispute and reporting should not be made.

    it cant be stressed enough how important it is to not get a default on your file. it last for 6 years from when you close the account so if you kept the account open for another 2 years it will be on your file for 8 years.

    Thanks. So the FOS would make them remove it if they have done it? Does it sound like they have already or will do in 28 days if I don't make payment? It's going through the courts so I'm not making payments at the moment.

    Should I ring them and make a token payment of a tenner or something and explain what I'm doing, just to stop this default thing? They have ignored my other letters where I've said that the banking code states they cannot default me when I'm disputing the account.

    i doubt any token payment would stop them at this stage. if you could pay it off in full this would be the easiest way to stop them if they havnt already done so. first thing to do is to check if they have actually put a default on your record.

    They have since sent me two more letters. One from an address in Fife, one from an address in Swindon!!!!! Both saying along the lines of "we're sorry you're unhappy with our service, we are investigating into it". What's the point? I wrote to tell them that I have filed a case at court and that they cannot threaten me with a default whilst my account is in dispute.

    I will check my credit report I think just to make sure they haven't put one on it!

    Right, just run another one for today.

    It is showing up that I have a credit card debt with Halifax. I DON'T. So this must be Marbles as they are now owned by Bank of Scotland. It is showing as a default.

    What can I do about this as my account is in dispute. It's saying my account defaulted in February 2008. Though my credit report in June 2008 showed no default so not sure where this is from. Is there nothing I can do to get this default removed?
