I don't know why this thread has been moved. It makes it all quite confusing as I have separate claims with 3 banks. Oh well. This is another update about MBNA.
Today I got a letter dated the 17th December regarding the cheque dated 22nd December which I received on the 24th December.
It follows on from the usual blah about them not agreeing with the OFT's ruling on unfair bank charges, with an explanation of the £78 cheque. They say that this reduces all the fees I paid before the OFT hearing to £12. They say that this is a goodwill gesture and say that they 'trust I will find this an acceptable resolution'. They say that in relation to charges made after July 2006 they will make no offer to settle this element of my complaint. As most of the charges are for after this date, and amount to around £500, I do not find the £78 offer acceptable.
Is it possible to send a letter accepting this offer as a partial payment without prejudice? They don't want me to sign anything to confirm I won't be persuing this any further, like Marbles did. If I can bank this cheque I can then afford to put in a claim with the courts for the full amount, otherwise I will have to wait until first week of January, but this isn't too far away.

Hi, I wondered if I could have a little help filling this form in please?
With all the Christmas hassle I've let this go on too long, haven't heard anything from Marbles or Virgin for ages so want to get things moving again, particularly before they start chasing me for money again.
In the above form, do I send it to my local court? So that would be Ipswich?
Who is the claimant? Me? And who is the defendant? Marbles/Virgin?
What do I put in brief details of claim? They both charged me overlimit and late fees continually each month whilst they knew I was in financial difficulty?
What do I put in value - is that the amount with or without interest?
Also, the bit at the bottom; what do I put in amount claimed, the same as above?
How do I find out the court fee? I put nil in solicitor's costs I presume?
Do I put Marbles/Virgin's address in the box below?
Does my claim include any issues under the human rights act 1998? I don't know!
What are the particulars of my claim? Do I attach a breakdown of charges?
Do I put anything else on the form?
This is all a bit scary, I've done a MoneyClaim online form a while ago but can't remember what I put.

I am unsure about whether I have to pay though and if so, how much? I'm a full time student with no part time job but my commonlaw partner has a job. Does anyone know?
Also does anyone know how long the case will take to be processed and also if there's a template letter I can send to stop Marbles calling me 8 times a day?

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)
