    Offer to pay something towards it while it is in dispute even if it is just £1 per week or something- that way at least they will see you are trying to be co-operative and it might encourage them to be. While you aren't paying anything they will be less likely to want to refund you anything because they want to keep hold of as much of your money as possible - especially since you have said you won't pay anything.

    I've got an ongoing problem with Marbles. I have filed a case at court with an N1 form and have....

    What should I do? Please help! I am so stressed with all this.

    Firstly, do not worry and get yourself all stressed up.

    Inform the court where your claim is currently held at with the correct details for Marbles as this will be updated on your court claim.

    This is the address that I managed to find;-

    Executive Complaints,
    HFC Bank (Marbles Credit Card),
    PO BOX 3607,
    BIRMINGHAM.
    B1 2XJ.

    Any written correspondence that you send to Marbles...make sure it is sent via Recorded Delivery.

    You are correct in the fact that while you remain in dispute of the account, the other party;-

    May not demand any payment on the account, nor are you obliged to offer any payment to them.
    May not add any further interest or charges to the account.
    May not pass the account to any third party.(DCA's etc)
    May not register any information in respect of the account with any Credit Reference agencies.
    May not issue a default notice related to the account. (unless the default amount was for the amount before any additional and contested unfair charges were added)

    You haven't stated how much the 'default notice' is for?


    I would refrain from reasoning with them via telephone, as they have had the chance to do this before you filed your N1 via your local court.
    And do not make any payment offer to them.

    Write to them, again stating that the account is in dispute and that whilst it remains in dispute, no further payments will be made.

    They know that they are in breach of issuing you a default notice whilst any claim is in dispute if any monies they are asking for include charges for creating that default in the first place. And given that is at court stage.

    So do not be intimidated by them! ;)

    Should I just send them the same letter again but with more emphasis on the fact that they are in breach of the banking code by threatening to issue me with a default charge?

    They have put my account up to £699.27 now, and that's how much the default is for.

    I'll give the court a ring and see what's going on.

    Phoned the court and they say they've received my amended form but haven't got round to doing it yet, but once it's done they will send me the amended copy and the copy to Marbles.

    Doshamento - that address you found just proves my point about how many addresses there are for this damn company :rolleyes: Anyone would think they didn't want to be contacted :rolleyes: I think I have at least 5 possible addresses to send them correspondence to, then they can say "oh we haven't got it" and make you waste money sending it again to another address :mad:

    When you mention 'amended form' do you mean that you made an amendment to your particulars of claim....i.e did you complete a Form N244??
    As I am unclear?

    If you have, then your new particulars of claim can include reference to the 'default notice' that you have subsequently received and it's incorrect amount that you disagree with.

    One important thing i'd mention is to pay attention to your credit files.

    If you have received a 'default notice' then it will more than likely be registered on your credit files by them.

    If this is the case, then you must disagree with the default notice stressing that it has been placed on your file incorrectly - otherwise it will stay there for 6 years making any sort of credit very difficult to get in the future.

    How do I disagree with the default notice? I thought they weren't allowed to give me one?

    The amended form was purely another N1 to correct their address. I haven't mentioned any extra charges, but as I've told them, they aren't allowed to charge me anything extra as my account is in dispute.

    If they have defaulted my account how do I go about getting it reversed? I can't afford to pay for any credit checks at the moment really. Also I'm a student who's always had a bad credit file so don't suppose I'll be a good risk for a few years anyway :(
