  • now then after taking advice from this forum back in june i have now recieved (at the begining of sept) a letter from a debt collection agency claiming that i have to pay the amount plus a late payment cost within 7 days of a court summons would be issued.

    again should i pay or await the summons and go to court.
    i have had no previous corrispondance from the company who issued the ticked in the first place and then 3 months later i get a letter from debt collection.

    someone please advise.

  • Continue to ignore
    All other communication from a PPC is designed to scare & intimidate you into paying and has no "legal authority".
    Expect to get several letters from debt-collectors
    (which the uninformed "man-on-the-steet" often confuse with bailiffs) and solicitors,
    (Often not real ones but someone in the office).
    all threatening or implying dire consequences of non-payment. All of which is complete rubbish.
    Read through the many threads here about PPC tickets
    so the rules are:
    1. Tickets issued by the Police or by (or on behalf of) a Council = either appeal or pay,
    but come here for advice first
    2. PPC tickets = IGNORE COMPLETELY
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • I have received a parking ticket from a private company stating I have overstayed by 23minutes, time allowed is 1hour 30 minutes as I am a disabled driver and stayed in a disabled bay would I have a chance to appeal this fine and not pay the £90 they are asking for.

    Do not appeal.
    Do not contact them.

    File the letters and find something nice to spend the £90 you have just saved on.

    My 82 year old mother was given a ticket for not correctly showing her disabled badge.
    The ticket said badge not correctly shown (which means that the operative knew the badge was there)
    £50 penalty. This was by Euro Car Parks in Sainsbury's.

    Do the same rules apply as for parking, ie: ignore them?

  • I got the first letter today from Parking Eye for parking over the 2 hours limit at my local morrisons on 25/8. I can prove I was shopping as I have a statement I spent £140 that day in store. I plan on ignoring the letter but I do my weekly shop there, so if they notice, could they clamp me? Should I stay away?
    Any help is appreciated.
  • Some really good advice on this forum.

    One point I'd like to add is regarding the scare tactics these PPCs employ, to bully people into paying. Although the letters demanding payment may get more and more threatening and use bold wording and mention debt collection, increased charges, etc., this is all absolute nonsense.

    Please be assured, there is no debt - what exactly have you bought from these cowboys companies?? Any reference to debt collection is to be ignored and please be advised that as there is no lending in place, not paying these 'fines' (which are actually invoices for which you have received nothing in return) will not affect your credit rating one iota.

    Threats of bailiffs, court, charges, interest, seizure of goods, etc. are all simly scare tactics which will likely result in most people paying the 'fines'. Bailiffs cannot be used without a court order, for which the PPC would have to prove on the balance of probabilities that you had been party to a contract to which you were fully aware of and understood, that you were driving the vehicle, and that the costs to be recovered by the PPC are reasonable - which they NEVER are. In other words, the PPCs don't have a leg to stand on in a court room which is why they won't take you to court.

    It also costs around £35 to make a small claim in the court (before considering travel, staff time etc.) - that will buy a lot of stamps which is another reason why PPCs will inundate you with mail without actually following through with a court case.

    If you have been given a PPC parking charge, simply ignore the letters. In the end, they will give up!!

    (Apologies for a slight rant but I really despise these monstrous organisations and I believe that in say, 50 years, they will be heavily regulated).

    This is an empty threat - they will not issue a court summons as they will have no evidence to present and it will cost them £35 to issue proceedings which they will lose. This isn't a 'debt' as you never agreed to enter a contract for anything.

    Sit tight, have a laugh at the letters and think of the postage and staff costs they are wasting by sending out such incredulous correspondence.
