    Nothing will happen if you just ignore the ticket and letters.

  • Ok this is about clamping so not sure if it's the right place to post this. Here's the situation.

    Last night at around 2210 I parked outside my flats there are signs for no parking but the 2 that cover the entrance and the ramp that I park on have been turned by the wind or bent in half so hard to read. I took my pregnant girlfriend, 2 year old daughter and sick 3 year old son upstairs. It was late and didn't want to walk them from the car park 5 minutes walk away. 15 minutes later I came down to move my car and found it had been clamped, I called and waas told that it was illegally parked and would have to pay £120. Money I didn't have and was told I would have to wait until Monday to see if I could pay in installments but it was unlikely. My son then became more ill and I was told by the doctors to take him into hospital I called the company who refused still to remove the clamp I said I had £94.90 and they sent someone over. In the meantime my father in law took my son and partner to hospital he was given medicine and sent back and told to keep him under observation and come back if he got worse. When the clamper came back I told him about the money I had and he said he would have to call in to the office, he made the call in front of me and said that he would have to wait for a response. He told me to go back up and meet him in fifteen minutes as he was going to a shop to buy some cigarettes. I came back down 15 minutes later and waited 50 minutes and he still hadn't returned. I called the company and was told that he had been sent on an 'emergency' clamping call on the other side of london and he would be back within 3 or 4 hours.... it was just gone midnight at this point. finally my son fell asleep around 3 and they still hadn't come back. I called again at ten am and a very rude man answered the phone and told me they didn't come back because I didn't have the full £120. I told them to come back and paid the money.

    what should I do from here if anything>

    I have just received yet another letter re a parking invoice from last July. There has been a silence sinceabout October and now this. It states the debthas been sol on to a Parking Services Agency and although it stands at £130 for a quick settlement they are prepared to accept £79.99 or they will pursue legal action.

    Is this par for the course?
    Should I still ignore it?

    Par for the course, the "other agency" is probable the next desk along in the same office, just ignore.

    1st it would be clearer for you if you started a separate post as the answers given will be mixed with others and therefore could complicate matters.
    Do the signs say anything about clamping?
    Was it your car park or someone elses?
    Get photographs of the signs.
    Copy/photograph the ticket and release form
    Host all pics on tinypic and put the url (for forums) on here leaving off the http:// bit.
    That should get the ball rolling for a start.

    Just check the top thread in this sub-board each time you get a letter (this discussion thread isn't even supposed to be used for these sort of questions about individual cases).

    Well if you paid in cash, the only way to get your money back would be to take the clamper and whoever instructed them to the Small Claims Court. It's very important that you name both parties as 'jointly and severally liable' and you'd need to show why the clamping was unlawful, and was therefore 'tortious interference with goods' (the goods being your car).

    This may be because the signs were not sufficiently visible or clear in wording/contract implied (take pics of their position and their wording). Or it may be because their paperwork didn't include all the info it's supposed to (quite common).

    Read the FAQs first and read some of the threads to get the hang of the forum (you will see quite a lot of threads like yours which will give you an idea of the task ahead).

    Then register and post (not being funny at all, but please split your post into paragraphs like I have above in the quote, it's very difficult to read a big block of words!).

    Good luck, you CAN get your money back in Small Claims but it will take a few weeks/months and quite a bit of groundwork on your part.
