Have you heard the one about the clamping company whom is clamping on private land owned by Network Rail without there being any contract between NR and the company?

I guess I'm looking for some reassurance that this is going to go away?! please

YES!!!!!!!!!!!!!!!!!! It will go away! :D Believe us!

Pretty much all regular posters here have heard of Debt Recovery Plus, they are just another Debt Collector. Here's one MSE search result, google for more general results or search on pepipoo.com for reassuring results from people who have come out the other side:

    http://forums.moneysavingexpert.com/showthread.html?t=2121131

Also look at all the example letters people have posted so far here:

    http://forums.moneysavingexpert.com/showthread.html?t=2214803

What do you see in common about most of them? That's right, after a couple of pretty-coloured large-lettering threats from Debt Collectors (and maybe a letter on solicitor's headed notepaper if you are very lucky) they STOP.

Debt Collector letters are just letters. There is no debt. Stop reading the letters, that's what they want you to do; their psuedo-legal language and the extortionate figures are used to frighten you into paying a debt that you don't owe.

The figures are also wrong (Court claim costs £30, not £50) and inflated, they would not stand up in court but that's not their aim. They want you to fold, there is no Court case and this is their final (or nearly final) trump card. Call their bluff and ignore, you are near the end of the game.

And when they have given up, maybe you'll feel brave enough to please post your example letters on that linked Sticky thread, to help other people see it's just a scam that they can safely ignore? We don't have a TPS example letter-chain yet in our collection!

One of the things I thought amusing about the letter regarding my "debt" is that the figure claimed now is much less than the last threatening letter when court fees, DVLA search and all other nonsense had been added. Must be a bargain offer.

I have a week to respond and pay in full.

    I think I'll not bother.

I too am in the same position as Pinkpinkfizz. I received a few letters from euro car parks and since then 2 from George Walker & Co the last one being ''Final Notice'' before court proceedings. It was addressed to my husband although it was me who was the driver at the time. Before I discovered this site I had appealed because I had been transporting my disabled father at the time and although parked in a keep clear (which is still being parked on) I didn't display his blue badge. Anyway true to your site this was declined and even though they had my name and address they still sent off to DVLA for the registered keepers address??
Since my last post page 31 I have been taking the advice of the site and ignoring but like Pinkpinkfizz I live in Scotland and need reassurance that the law is the same as that south of the border. My husband is of a mind to pay up and be done with it. I say no hold out. If it did go to court what kind of defence would I have. I am prepared to go all the way but may need a bit more help from all you guys out there.
The ''invoice'' was received in August last year and the last letter from George Walker & Co received early January.

Yes, private parking tickets are the same in Scotland, you can safely ignore them.

A quick Google of 'private parking ticket Scotland' included lots of results including a pepipoo thread:

    http://forums.pepipoo.com/index.php?showtopic=29366

Couldn't be clearer. Ignore it, ignore the letters.

Why on earth would someone want to pay scammers to make them go away? That would be like paying one of those email scams instead of deleting it!

It's them going, "well we know your not going to pay the full amount, so if we offer you the chance to pay less you might be stupid enough to pay it"
  • You know what? I think a lot of you all rely on your mates telling you what to say and you inadvertedly spout !!!!!! Me and Pinkpinkfizz have a valid point when we are from north of the border and to be honest we have never been answered about the law differerence north or south. So come on guys whose right and whose wrong and what can we do about it all in Scotland if anythng???????????????

Well if you think we all spout !!!!! then just ignore us, its quite simple. We offer advice and not being solicitors has to he taken as just that.

Coupon-mad has answered your question about north and south of the border, if you want a definitive legal answer the you will have to ask a solicitor however the chances of finding one who understands about private parking etc are reasonably slim. Murder someone and they come out of the woodwork to help but park inadvertently in the wrong place and often you're on your own.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

Hi, we received a Parking Eye penality ticket for being 21 minutes over the 2 hour parking limit in a retail shopping car park in December 2009. We have ignored it. It is laughable really, since their own camera photo (included in a letter from them requesting £80 ) of us trying to leave the car park shows the reason for the delay, with a line of traffic behind and in front us and several inches of snow on the ground. There have been several articles in our local paper critising Parking Eye's conduct recently. This week I have read that Parking Eye has lost their contract with this retail park due to the number of complaints the retailers received. The paper is quite scathing in it's comment that "although Parking Eye broke no industry rules, it courted controversy when it issued a number of ticket to motorists effectivly trapped in the cramped car park before Christmas....Parking Eye has denied that shoppers were unfairly treated". Judging by comments in the paper, no appeal to Parking Eye from those issued with penality letters worked, so like others have said it is not worth the effort of trying to appeal.

Thanks for not reading my post, just 2 above yours! Wish I hadn't bothered in a way but I'll give you the benefit of the doubt and assume you were tired late last night and missed it...
I gave you the answer about Scotland!

But seriously, we are giving up our own time to advise people on here and do you know why? Because - myself included - we have almost all had at least one private parking ticket and ignored it - and nothing happened. Some people collect them deliberately - and yes, in Scotland too - just to waste the PPCs time and money.

We are not lawyers, we are people who have recent and relevant experience of this scam. As PTP says, most Solicitors would not know how to advise you for sure without spending your money checking case law etc. We give the correct advice here for free.

On the pepipoo.com link I gave you (they are the experts on fighting/ignoring parking tickets), that was just one example of someone asking on there about private parking tickets in Scotland. There are load of others on pepipoo and if you'd just google 'Scotland private parking ticket' like I did you could read about other cases like yours.

In fact if you'd like to post on pepipoo, they do have some legal people on there. I expect you'd rather hear the word 'ignore' from 'legal people' rather than me so here's the link to the right forum for you (but please don't throw your toys out of the pram when the busiest posters take a couple of days to reply, when they get a spare few minutes...):

    http://forums.pepipoo.com/index.php?showforum=30

Please don't pay the fake PCN - anyone who does is a mug but is also lining the pockets of these scammers - which allows them to continue. You'd be funding their scam!
