    Should any contract exist then it exists between the Driver and the PPC. The Registered keeper has no legal obligation to name the Driver. Let them swivel. You have no obligation to pay this.

    No, you can't get a conviction for something which is not a criminal offence (scourcs-Northampton CC) I used the Bill of Rights Act 1689. I did not use the appeal system, I bluntly said is wasn't paying it.

    Bill of Rights "Promises of grants, fine and forfeitures of particular persons before conviction is illegal and void". The fine is illegal because no company or authority can issue a fine, authority means, Council, Inland Revenue etc.

    The fine was cancelled. Do not fill in appeal forms or recognise them. Even an ajudicator cannot enforce a fine.

    Correct- you are not in trial "now" so there is no need to defend yourself. You do not have to admit being the driver, it contravenes the Human Rights Act. You do not have to pay it because they have not used the correct method of persuance and they cannot issue a fine, they are claiming powers forbidden to them. (Bill of Rights)

    I've had PCN from Parking Eye and foolishly contacted them prior to reading this forum! As I've made this contact are they more likely to take the matter further?

    In a word - yes. Just make sure you ignore anything else that flops through your letterbox.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Is it worth me getting in touch and saying that I have checked my dates and that I wasn't the driver on that day or just ignore everything from now on?

    I am in the process of replying to them, stating that "as I have had a satisfactory conclusion I will be cancelling the invoices"
  • I received an invoice, cunningly disguised as a PCN, from MET Parking Services because my car was parked at a McDonalds for more than 75 mins. The car was there because my daughter was attending a 2 hour birthday party organised by the 'restaurant'. I was not the driver. I was at work.
    I took the advice posted on the forum and ignored it along with the next 3 letters. The charge increased and so did the threats (court, bailiffs etc) but eventually they gave up. I was tempted to tell them that the driver was a Mr. Ronald McDonald and give them the address of the 'restaurant' as his address. However, that would be dishonest!
    Ignore everything is definitely the best advice. MET have proved it.
    It is tempting to start an argument with them as to why I will not be paying the fine (Eg I was not the driver and as such it is impossible for me to have entered into a contract with them, I am not legally obliged to say who the driver was but good luck with your efforts to catch them... ) but it is not worth the time.

    Ignore them all.

    This is a very long thread so previous posters may have mentioned it? For these private car companies to identify you they have to get the DVLA to flick the registration number, as such the Data Protection Act comes into play.

    If you do have the misfortune to get one of these parking tickets was a "Fair Processing Notice" in place in other words did the company that slapped you with the "fine" say on their signs that they would contact the DVLA so that you could be identified you.

    IF the signs are correct I would them hit them with a subject access request asking for ALL information they hold on you, this must include photgraphs CCTV etc as it is all subject to DPA and they will have to produce everything, so if you have parked in the same car park a few times they should have that information about you as well, the fee is £10 including P&P

    If you are not happy with their response, or they fail to provide you with the information, request the Information Commissioners Office to carry out an assessment, another of our rights under DPA.

    You may also want to hit the DVLA under Freedom of Informantion Act about what steps do they take to protect our information and again ask the Information Commissioner to carry out an assessment to see if they are breaching the Act, particularly around Section 55 of the Act in that they were careless (polite wording) with the information they held about us
    Private Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA :D

    I should have added of course, don't give them a penny, plus you get the satisfaction of knowing it will have cost them far more to even start processing the Subject Acces Request
