You seem to be implying that I did not send the item back.
As stated in my original posting I sent it back as instructed by Paypal.
I too have sold items on e-bay, however I package the items so that they arrive intact. I would expect to pay the price if I didn't do it correctly.

Paypal say they offer protection but then they find whatever excuse to pull out.
I made a purchase and the item that turned up was not only broken but not as described. I entered into dispute. Paypal said send the item back. Seller did not pay up. I told Paypal I wanted my money back under their guranatee. They tried to wash their hands.
Trading standards say Paypal come under the FSA to whom you need to make a complaint. Paypal is not registered in the UK but Belgium. But after dozens of emails to paypal and them dismissing my claims I demanded all information regarding my case under the data protection act so that I could then take legal action. Guess what they gave me the money back but said they did not acknowledge liability.
In the US there is a class action taking place against Paypal so be warned.

I have waited long enough and paypal don't seem to know what they are doing, as yet I have no idea how much legal action will cost.

a case in small claims is peanuts. you can do it all yourself.
Remember the time he ate my goldfish? And you lied and said I never had goldfish. Then why did I have the bowl Bart? Why did I have the bowl?

Today they have sent me an address to write to requesting all of my information under the data protection act.

This is about my, "Unauthorised Account Access Claim" !?!?!

    Says it all!

Have a think about adding paypal in as a third party that you are claiming against.

write them an e-mail to that extent also. might make them concentrate.

  • I've had two similar experiences with Paypal. They are terrible to deal with and as far as my experience goes -have offered me no protection whatsoever either as a buyer or a seller. I wish you luck in getting them to pay up what is owed to you.

I had an issue with an ebay purchase I made [2nd lenese not delivered with a camera and lens]. PAypal !!!!ed me around, etc. Credit card didn't wnat to know until got a 'rejected' ;letter from Paypal.

So I did and then did a chargeback to the supplier via my c card.....job sorted.

Thats why you should use a c card for your Paypal accoutn..not a debit card or chq/cash/whatever else.

Similarly it's why you should use a cc for ALL purchases ...making asure yiou have a DD set up for the full amount to be taken every month.

Well they have finally come clean look at this!

"Please be assured that all actions taken in this case were completed in
accordance with the terms of the PayPal User Agreement, to which you agreed
when you created your PayPal account on ** ******* **** (My deletion). The section of
the User Agreement relevant to your issue is listed below and can be found
by clicking on the “Legal Agreements” link at the bottom of any PayPal
    page:

1.1 PayPal is only a Payment Service Provider"

SO THE GUARANTEE IS A FAKE!
