The Mobile Outlet appear to be total crooks. They have used all manner of avoidance tactics from paying out any of our cashback claims. My husband and I took out separate contracts in Feb 06 so came to apply for cashback in July. They refused my husband's due to 'no dispatch note' even though this was NOT one of the terms and conditions of our contract. PLEASE NOTE - I HAVE TAKEN LEGAL ADVICE AND THE TERMS AND CONDITIONS THAT WERE IN PLACE WHEN YOU TAKE OUT A CONTRACT ARE THE ONLY ONES THAT APPLY TO THAT CONTRACT UNLESS YOU HAVE BEEN NOTIFIED IN WRITING OF ANY POTENTIAL CHANGE OF TERMS. Mobile Outlet appear to be trying to con as many people as possible by sending out these refusals on NEW terms and conditions that DO NOT APPLY UNLESS THEY WERE IN PLACE WHEN THE CONTRACT BEGAN! After we sent a letter to them (cc'in trading standards and '3' network), they subsequently sent a letter back saying nothing about the 'missing' dispatch note, but that our contract was for 18 months (NO - it was for 12!!!) and that we should apply for cashback later. Again we sent a letter giving them 7 days to respond and pay in full which they have ignored. We are now pursuing this through Money Claims Online (part of the small claims court). We have heard nothing regarding my claim (which from reading these postings I suspect they will refuse as 2 of my bills did not arrive so I obtained second copies from Orange!). Nonetheless, I have written to them about this too and am also threatening small claims action on this too.
As regards trading standards - I recommend as many people who are suffering similarly at the hands of this company who appear to be flagrantly flouting their responsibilities and using underhand avoidance tactics to complain to trading standards / consumer direct (details can be found online). The more people who complain, the more likely they will be to do something about this!0 -
I got a letter from MO again refusing to pay the cash back even after I had sent the bill after requesting from 3 (as was agreed with one of the personnel from MO that this would be OK)---now, they have refused.......I am planning to take them to court.......I am only a bit hesitant that the 1st bill I sent looked like a copy although it was sent by '3' and they confirmed over the phone to MO that they have issued it.....But, after talks / follow ups for couple of months MO told over the phone that getting a bill again from '3' and sending would be OK..which I did ..but they have now refused that they said this ....Any advise on what I should do would be appreciated? Also, say I take them to court and if I loose (I don't think I will)....what will be my damages ----do I have to pay for some other charges after the court fees of £ 30 or.......0

I'd say you should send the whole lot. Mobile outlet never keep their promises. Or if you just wanna send the bill summary, do print out a copy of this e-mail.0 -

Having read through this thread I am shocked that there are people out there still considering buying from this company. Have you read this thread !!!! If you do get your cash back it is pot luck !! They are trying everything possible to deny you your cashback and no doubt tomorrow they will find other ways !! Eventually, they WILL go belly up !! At your expense.
My sister took out a contract with MO approximately 7 months ago I thought they were too dodgy but she thought the deal was too good!!! She was as meticulous as can be !!!!
Anyway after requesting her first cashback she got a letter today as the others refusing to pay as she had not sent a despatch note. Same old story.She new nothing about this but they waited 28 days before informing her so she was out of time to submit anything anyway. I've referred her to the many excellent posts on this thread thank you to the many MSE members for their help and advice as there is light at the end of the tunnel be it a dim one. Naturally I expect her to get her money however if everyone gets there money how are they going to survive as a company !!!0
