    I hadn't realised they would only be reduced by £5 per year :eek: :eek: They have definitely contacted him/his employer about my case, but they said I couldn't be assessed on my own - that it was 'attached' to PWC 1. I thought they might have to phase down the payments he was making, but I didn't realise it would be over such a long period of time.

    As far as i am aware that is still the way it works. The point is even if this were not the case then arrears are now building up on your case. If he is not putting money aside then there will be a large bill to pay when the assessment does come through.

    Personally i don't agree with the phasing being structured the way it is. But it is there so that PWC 1 does not have a large drop due to a new CSA case being started with the NRP. Five years does seem excessive though.
  • I don't know whether to mention it to him or not. Everytime we talk about money, things get ugly because he feels guilty that he's not paying me anything :(

    It would be reduced down in either £5's or £10's each year for up to five years for the old case to go from old rules to new rules amount - it depends on his earnings.

    Also, there wouldn't be any arrears on your new case - as its a multi, it will have a future effective date, which will be in the week after they finally assess it.

    In this case, i'd keep phoning CSA, contact MP, then contact ICE - it will all help in getting it sorted asap.

    If this is the case i apologise OP. I was not aware that this is how the future effective dates work.

    If so then all the more reason to harass them !

    If its agency fault that the new case can't be progressed (which it sounds like), OP could claim for financial loss once the assessment is in place - worth a try!
    She could claim for the maintenance amount, from when she applied (when it should have been assessed), to the effective date (when it was actually assessed).
    It sounds like it could be quite a long period of time.

    That will be a fight !

    I still can't understand why the effective date cannot be the same as a new case, i.e when the NRP is contacted. Just seems nonsensical.

    In theory it should happen less often the further away it gets from the date CSA1 cases were no longer being implemented. Though when CMEC rules fully kick in there could be a repeat of the same !!!! ups !

    You need to as others have said complain assertively and frequently. Take the initiative and don't wait for their phone calls. It should not be this way but it is .

    The reason why phasing still exists is the same as why your problem exists. Lack of manpower and skilled workers. Make sure you get put at the top of the pile of cases !!!
  • Well I plan to phone again tomorrow to ask why no one called me back. I will be persistent because I want, no NEED this sorted out.
