Merry's adventures with the CSA

He says he can't afford to pay me anything - something not quite supported by the new tv and dvd player he bought when I finally managed to move out with the kids, but that's by the by.
And no, I don't think he has told Ex1 that he is being reassessed - she doesn't take any !!!! and I think he is trying to avoid that explosion as long as possible :eek:Get free advice before embarking on bankruptcy: CCCS 0800 138 1111 National Debtline 0808 808 4000

Is the first ex on csa1 or csa2?0

Believe it's csa1 as it goes back to 2000. I know that any assessment will be done alongside hers.Get free advice before embarking on bankruptcy: CCCS 0800 138 1111 National Debtline 0808 808 4000

MG
You need to keep pushing and pushing them. Contact your MP and get the assistant to phone the Parliamentary hotline. Hopefully that should speed things up.
You really need to get the Parliamentary Business Unit onto this.
As for the arrears there may be a possibility that if he is DEO'd the arrears will be paid off within 2 years.
I know this is frustrating, but there are lots of PWCs on here that have been waiting for years for arrears to be paid off. It doesn't help when NRPs can pay off arrears - interest free- piffling little amounts each month.0 -
It will have been transferred over to CS2 because of MG opening her case.0
-
I'm sure her payments will be phased onto csa2 so it gradually reduces to the new assessment amount - anyone know for definate?
If they are phased, he will spend a few years paying more than he may be anticipating.0 -
Just heard back from them following the letter I wrote 2 weeks ago regarding special payment due to maladministration. So that's two people calling me back today to see if they can 'chivvy' things along :sigh:Get free advice before embarking on bankruptcy: CCCS 0800 138 1111 National Debtline 0808 808 4000

I think your ex may be in for a nasty shock. If PWC 1 is indeed a CSA1 case then payments will be phased which can take up to 5 years and will reduce by £5 per year. In other words his liability to her will only reduce gradually.
Merry ,what you need to make sure is that the CSA have contacted him regarding YOUR case. This sets the effective date and is when arrears can go back to.
His claim he cannot afford payments will mean nothing when the case is assessed. They will go for Deduction of earnings orders and liability orders if he does not stump up. Chances are they will also expect any arrears to be repaid within 2 years.
Like i say this man is in for a big financial shock, the sooner he faces up to this the better for all concerned.0 -
I hadn't realised they would only be reduced by £5 per year   They have definitely contacted him/his employer about my case, but they said I couldn't be assessed on my own - that it was 'attached' to PWC 1. I thought they might have to phase down the payments he was making, but I didn't realise it would be over such a long period of time.Get free advice before embarking on bankruptcy: CCCS 0800 138 1111 National Debtline 0808 808 4000
