Argos - Wont refund or exchange ??? Help

I bought a watch yesterday from Argos.
The watch was too big. The lady said we dont take out links but if you take it to xxxx jewellers we have an agreement with them. Just bring the receipt back here and we will refund the cost of them altering it for you.

I took the watch to the jewellers, they said while we alter it just pop back to Argos and claim your refund. I did.

Then I went to collect my altered watch. This is the problem:
It doesnt fit the links are too big. So its either too small or too big. The jeweller said do you want to take it back and I'll put the links back. Yes I said

I took the watch back to Argos. It's exactly the same as it was when I bought it. The links are back in. They said No they cant exchange it or refund it as it has been tampered with.
I see their point but like I said to the shop assis and manager if they would offer an altering service then I would of known straight away before I bought it.
I so fed up now. Im stuck with a watch that I cant wear.

Do you think Im in the wrong here?

    Take it back to another argos and say nothing about the history.
    Just say it doesn't fit and you don't want it altered.

    You could try again at s different time (sunday?) when there maybe different staff.
  • It is rather odd that they would suggest you take it elsewhere to be altered. We do all our alterations in store, and if we can't alter it we send it off to our jewellery repair service Maker Mends.
    As for taking it to another store to be refunded, that is a little sneaky. It is illegal for Argos to sell second hand goods, that is why they won't refund anything that has been used. How would you feel if you bought what you thought was a brand new watch and you saw it had been tampered with? I'm pretty sure you wouldn't want it.

    So, you don't give a damn that someone will end up getting "ripped off" by buying effectively a second hand watch at full price, so long as you get your money back? :rolleyes:
    Could you give it to someone as a gift fr Christmas/Birthday?

  • I can see your frustration and I would be annoyed too if were in the same situation. The watch must have really big links for it to be either too small or too big. Out of curiosity which watch is it? Is it an expensive watch? Would it do for someone's christmas present? Failing that, if you're happy to lie to another store to get your money back just make sure there are no marks where the links have been taken out as they will inspect the watch before agreeing to refund.

    It does make me laugh that the first thing people have said is take it back to another store, but they would be the first to complain if they recieved a used item from Argos (and there are several complaint threads on here).

    Goods have to be fit for their purpose. If the watch strap cannot be altered so that it fits your wrist it is clearly not fit for purpose. That alone entitle you to you money back.

    Additionally, you relied on the expertise of the salesperson who sold you the watch who said that the watch starp could be adjusted to your wrist size. That advice turned out to be wrong, so you have further grounds for returning the watch.

    I suggest you write to the store rejecting the goods.

    Better yet, sue argos because you have a wrist that doesn't fit their watches, a link left in is too big, a link taken out is too small. Argos are obviously selling inadiquate watches! Sue em! :rolleyes:

  • Argos do not sell made to measure watches. They didn't tell the customer that the alteration would make it a perfect fit. Just because the watch is (probably slightly) too big doesn't make the watch unfit for purpose.
