  • I've been away from my PC for a few hours, and hence have a dozen pages to read through - so my apologies if someone has already stated this.


    At the end of section 2.6 in the terms and conditions:

    "Repayment of such monies will be the extent of our liability to you if we are unable to deliver to you the Products you have ordered."

    So if they can't supply the goods (for whatever reason) they only owe you your money back - seems clear enough as you've agreed the terms by purchasing the product.

    Is it really worth sueing them? Unless of course there's alot of money at stake - in which case you are not a student and are taking advantage of the situation anyway!

    It'll be interesting to see how many sleepless nights this causes.

    Presumably they have to make some effort to try and supply. And as they have them available on the normal site still they must have some, or access to them.

    Otherwise you could just have these phantom products on websites luring people in just to get them to visit. You can't beat word of mouth for getting people through the door.
  • I think if i do get this then I'm going to have to relearn how to use a camera again properly - looks a great piece of kit, beraring in mind that it's not a point and shoot.

    One of the first things Apple will probably do is check that the orders do originate with students & teachers et al, which should winnow out a fair few punters - Teachers etc should have a DFES number and most real students have either a Uni or college number(or NUS).

    You can't have it both ways - arguing the legalities of a mis-price and then go on to say that you got it for a freind of a freind who is at Uni, etc.

    Never mind bringing in Trading Standards and Lawyers - You'll just be wasting your time. :rolleyes:

    Just be grateful if you or someone else does manage to get it, and try and be quicker off the mark next time ;)

    I am very grateful to the OP for this and I will be even more grateful if I get it. I am a student and my camera's knackered and am fed up with crummy pics of my kids on my phone.

    If they have sent out confirm emails and taken payments, and still advertise at full price on normal site. It's going to be hard for them to justify cancelling the confirmed orders based on their t&c. Gonna be interesting to check up on this tomorrow. hehe.

    As always in such cases, I have to marvel and chuckle at all those who are bleating that the seller should honour what is likely to turn out to be nothing more than an error on the part of an employee.......... I laugh because I just know that were the boot on the other foot, the very same people would be bleating that it was quite obviously no more than an honest mistake and one that nobody could possibly expect to see honoured. ;)

    Wouldn't they still lose out on the transaction charges that they need to pay the to the credit card companies that process each of the payments? I'm not entirely sure how the whole system works but I'd imagine that they're still losing some cash even if they just refund all of the paments, which makes them seem a bit slack for taking so long to pull the discounted camera from the education shop.

    Yes very good point. I'm not sure if large companies pay per 1000 transactions or a fixed fee or similar rather than per transaction. Have apple taken money?

    In this case I don't believe they did it just to get people there, heh, but I can see others trying it if it wasn't illegal or likely to cost them.
  • My son ordered one 3 hours ago. Now we can't find the camera on the Apple site at all. I assume its been removed (or is it me?).
