mac laptop - not 'brand new' as advertised

hi bought item 300269853071 on e-bay last week. Mac laptop - 'brand new' not out of box etc. Paid £450 for it including postage/insurance.

Received it this week. It is not 'brand new' and had some minor scratches on casing. It works ok, so far. We checked the number on apple and in fact the warranty expired in September 08 so it is at least 14 months old.

I've emailed seller and his response was - "[FONT=arial,sans-serif]I have not actually seen the laptop because obviously I left it in it's box since I got it.

The only reason for the scratches could be that it is a refurbished model from Apple. As I'm sure you're aware they wouldn't resell something that was faulty.

To answer your question as far as I am aware it is new.

Again, I am sorry that you have your doubts. I was sure you would be overjoyed with your purchase. "

Advice for where I go with this gratefully received. I feel I've paid over the odds for a not new laptop - and it isn't as advertised. Can I ask for a partial refund? Suggestions please.

    You can try asking for a partial refund but you are reliant on sellers goodwill, alternatively you could try a SNAD claim via paypal but you are not guaranteed a win as it is still new in box just not current.

    Incidentally I think with the feedback of the seller you were brave to bid, not many would have risked it on an expensive item with so many 'I thinks' and not many definities in the auction text and with a negative comment that says

    "Item was clearly not Brand New as Described, packing was torn, beware of seller"

    Or it could be the retailer / apple shop (if bought from there) have opened up and checked the item before resealing the box, inadvertantly scratching the machine.

    Its not uncommon for "good" retailers to check items before they are put on the shop floor or dispatched.

    Are they deep scratches?

    yep - for 'brave' read stupid - I know. My daughter has been trying to buy one for ages and it was a desperate bid. Thanks for advice anyway

However paypal would have to decide whether new in box is an accurate statement even allowing for it to be not a current model and showing some cosmetic damage. You would have to show , or at least convince paypal that it is Not new and boxed, ir significantly not as described.

    Even if you did win the claim you would need to return the item tracked at your own expense and in the same condition your eceived it. So no good if you have already done anything with the laptop.

    Another clue to the use of a macbook....

    Look to the left and right of the trackpad, on the very edge of the casing macbooks crack, if you have signs of cracking there, or even fragments missing (its hard to notice unless you are looking for it) then you can assume the mac has been opened and closed a lot in the past as its caused by the 2 strips at the top of the screen hitting the casing at the bottom.

    Interesting, my iBook has a slight crack below and to the right of the corner of the keyboard, is this the kind of thing you mean? I don't fully understand what caused it though, I don't see any visible strips?
    My TV is broken! :cry:

    Its a really common problem, and if you take your ibook to apple they should replace the casing for you as they are aware of it.

    At the top of your screen on the very edge of the casing to the left and right of the camera there are 2 "ridges", these line up perfectly with the cracking on the lower casing. It weakens the casing there. With yours being an ibook you may have the raised dots instead, but its all caused by the same thing.

  • Hi, i would open a dispute with paypal, you'll probably never be happy with your buy, if you think you've been had! I had a similar problem, and seller didn't want to know, yes you will have to stand cost of return postage, but you will get the full amount paid for the item back from paypal, who will claim it from seller. hope this helps, I HATE SCAMMERS!!:mad:
