mac laptop - not 'brand new' as advertised

    The specs for the MacBook you bought are for one made between May and September 2006 !!

    I am not sure why the warranty would have expired in September 2008 - someone must have registered it with Apple (Apple would have estimated it would have been sold a few weeks after the manufacture date). If you want to know when it was built then look at the serial number on the grey label under the battery or in System Profiler - it will be in the format 4H626XXXX - the 3rd digit is the year (2006) 4th and 5th digits are the week number (01 first week in January in this case week 26 - end of June).

    A MacBook with those specs is probably worth £350 so you paid a bit more than it is worth but if it is unused (which I doubt) maybe worth a little more than the £350.

    Check how many cycles are on the battery - System Profiler > Power..

    As above, but in case you are not familar with mac, system profiler can be found by clicking on the little apple icon in the taskbar at the top left of your screen

    Hi, had a final e-mail from seller this morning, again saying 'brand new' etc etc sorry I'm unhappy but tough luck. Anyway OH said, show me his page and you can leave feedback and draw a line under this .... except......

    When I paid for it, through e-bay there was a 'problem'. So my money bounced back and I paid again - (checked my CC statement and only paid once) - but the second time I went just through paypal so of course I can't now leave feedback as it is showing as still outstanding on my e-bay account.

    So, what now? I believe I can get a refund via my CC? but do they then get it back from him? and can I report him to e-bay?

    oh... and it is 72 cycles ......

    If it is 72 cycles that means that the battery has been charged and discharged 72 times. So it is certainly not brand-new. Probably has been used for 12 months...So SNAD in eBay-speak. Putting the MacBook back in the box does not make it brand-new - sorry. A new MacBook will have 1 cycle on the battery - they are charged before they put them in the box. Your strongest proof that it is not new is the battery cycle count - take a screen print of it.

    The MacBook is worth about £350 so might be worth negotiating the price down to that level if you want to keep the machine.

    Contact your credit-card company - the chances are they have not paid PayPal yet anyway.

    Ask the seller again for a refund - if no joy then open the PayPal dispute - even if it says that you have not paid on eBay you should be able to match the PayPal payment to the item number.

    As a guide for you, my macbook is 13 months old, used daily and has 157 cycles.

    Had yet another response -

    Seller states he is not aware of the processes that macbooks go through in production and is sure I'm not either. He cannot account for the battery charge count but can clarify as he has from the off that the laptop has indeed sat in it's box untouched as he said on the item description.

    Other than that - he says has stuck to the item description and has been honest from day one. If I want (!) I can get my credit card company involved - and finally, he states he does not wat his personal information spread around as he expects me respect that it is confidential - not quite sure what he means by that.

    Why haven't you opened a snad with paypal yet as already advised?

    It seems quite obvious he doesn't want to give a refund so just escalate it straight to a claim.

    Ok - the auction description says Brand New and Unopened in bold at the top of the listing - clearly neither of those statements is true.

    The battery cannot charge and discharge 72 times while it is in the box.

    The auction also states 2GB ram - does that agree with the specs on the label on the bottom of the box and the gray label under the battery ?

    I doubt it will - so how did the 2GB ram jump into the MacBook ?

    The machine is not new - why describe it as such ? Other than to get more money for it and hope the seller does not notice.

    What personal info is the seller talking about ??

    Thanks - I've lodged it with ebay as SNAD - I didn't do it earlier as I hoped for a friendly resolution (yes, I'm very naive and always see the best in people which is why I'm in this pickle in the first place!):o

    Will check the rest of the spec just out of interest...... hmmmm perhaps he could have advertised it as a self-charging/upgrading and scratching mac book .... ;)
