Parking Ticket Appeals successes and failures

I parked at rishworth centre car park in Dewsbury in October half term 2013. Stayed a few minutes over 2hrs
Received the usual demand for £100 but £60 if you pay early.
Letter also refers to appeals but gives no indication of any possible grounds. Their website also makes reference to online forums and quotes court orders in their favour. Ignoring all this we appealed and also wrote to the shops stating we would be deterred from revisiting.
Appeal on the bases of
1) genuine shopper ( spent money in shops including Next Clarks and Halfords and had copies of receipts)
2) calculation of loss as per mse standard reply
3) Insufficient time - we were taking an elderly and infirm person shopping.
received a letter from parking eye saying the charge was dropped but no indication of on which grounds.
later got a letter from Next saying they had had the charge cancelled. So thank you to them0 -
In the space of one week, i received four Ntks from G24 Ltd. The overstays ranged from 2-5hrs. Following advice from the Parking Cowboy, I sent a letter challenging them.
The first charge was waivered straight away, as I think the request for so much information showed them I wouldn't be a pushover.
I wrote the same letter for the other three ntks but the reply this time was ' sorry your challenge is out of date, pay up or face debt collectors'.
I replied quoting the PoFa 2012, which says the 28 day challenge period begins two days after the ntk was issued hence my appeal is valid, so waive the charges like you did before, or provide the info requested and a popla code.
Yesterday I received three sperate letters from the lovely Spicer at G24 ( Spicer is the name of the person that signed for my recorded delivery letters). The letters said each charge had been waived and no further action was needed by me. No mention was made as to under which grounds.
Personally I don't think he wanted to pay £108 for the pleasure of losing at popla. And due to reading this and the pepipoo forum I've saved myself £400 (not that I would have paid it anyway).
Can't post links but the Parking Cowboy ' template appeal letter' is what I used.0 -
Lucky, lucky - to have have come out of this with no hassle with appeals and POPLA submissions.
Did you buy a lottery ticket this weekend? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Will do if I can get my colleague's waived too.0

Another poke in the eye for Parking Eye from me
Followed the process through this site, appealed on the grounds that their charge wasn't a genuine pre-estimate of loss and the assessor agreed with me and make the same comment about their business model as they did to Barbsch a few posts up. I'd advise anyone to hold their nerve and appeal against Parking Eye. Merry Christmas

Excellent result.
Here is someone who initially came to the forum 'confuzzled' in their own words, but with some gentle pointers in the right direction took the whole process from soft appeal through to POPLA on their own with no further advice from the forum.

Could you please amend your "POPLA decisions" post to include the name of the PPC . This will help the likes of Parking Prankster to keep his tally of POPLA decisions up to date. Thanks! What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
Hi
Thankyou for the advice on your website about unfair parking charges.I was in a Co-op supermarket car park run by a company in Liverpool.I went over the 2hr limit by 17 mins. They billed me for £90 or £45 if paid within 14days..[on their sign it said you could further reduce the charge by paying over the phone before leaving the car park.] Please ignore it.
I had made up my mind I was not going to pay a penny as I felt the charge completely unjustified.A friend mentioned Martin's site, which had brill advice.
I wrote to the parking company using the unfair charge scenario, plus the fact I could not afford such a sum,I simply told them I was not going to pay.
I also wrote to The manager of the Co-op store in question, and the managing director of the Co-op group in Manchester,I mentioned it would be better to have 2hrs free parking and pay and display for extra time so people could shop in peace not stress. I enclosed a copy of my letter to the parking company to them.
Two days ago I recieved a letter from the Co-op telling me they had instructed the parking company to drop the charge.
I feel this is a result for common sense.
Thankyou again

Thank you moneysavingexpert! I was gutted to receive a parking charge notice from private company G24. I use a B & M car park every week to drop off and pick up my husband from work. I received a letter stating I owed £90 as on one day had stayed in car park for 566 mins-they have a regulation of 90 mins free. They had photos of me exiting and entering but failed to show I had exited and entered twice that day. I do it every week and had for months, they had clearly picked up on my habits and thought they'd try it on! I read your advice and wrote appealing the charges using your template letter using the alleged contravention did not occur. It worked! They replied that the charges had 'been waived'. Thank you so much0
