They kept saying that I had no proof that the phone was faulty despite me having two repair notes from motorola which had both been for the same fault which kept re-occuring.

I worked in Argos customer service for 3 years, usually I bent over backwards to help people and try to keep within the rules but sometimes peoples reasons for returning items were beyond ridiculous. I remember one woman returning a deep fat fryer because it had no handle for the basket. She had opened the box upside down and was completely red faced when I turned the box the right way up, opened it and presented her with the handle which would have been the very first thing she had seen if she had opened the box the right way up.

SomeGuy - great post - quite frankly it had to be said.

As a retailer the moment someone says the immortal words 'I know my rights' my heart sinks. Why? Because I have never met anyone who has said that and then demonstrated a correct and comprehensive understanding of the law.

I asked the last person who said that to me to explain those rights to me. He was trying to refund a well worn pair of shoes because after he wore them they smelt. In my view it's an occupational hazard of having feet. He then said "the law says you must do what I want".

I've also had people with absolutely no grasp of anything let alone the law claim to be Lawyers and Trading Standards officers in order to get refunds. Interestingly enough they had no knowledge of the law or in the case of the latter had no ID and seemed uncertain of where the local TS office was.

Some Retailers make it harder for others.

I purchased a car kit (Nokia CK7-W) for my Nokia 9500 at the time of purchase I took the handset in with me, and checked with the seller that the car kit was fully compatible, assuring me that it was "after all it was made by the same manufacturer wasn't it" his words not mine.

Once I installed the kit it was discovered that when the phone is connected to the pop port for charging and use, it disables the remote button for answering and disconnecting the calls.

    after 2 weeks of.

You have wired it up wrong.
The manager is out of the office.
You cant have a refund as its against company policy.
You installed it yourself so you cant return it.
We were not aware of this problem, so was sold in good faith.
Maybe Nokia can issue a software upgrade for the Car Kit or the Hand set.
You have had it longer than 7 days so you cant return it.
You must be mistaken it works in blue tooth mode doesn't it, so it is working isn't it.
You can use another charger to charge your handset and still use the car kit in bluetooth mode.
It must be faulty, we can exchange it for you.
We can give you a credit to-wards another car kit.
You should have tested it before installing it, as you have opened the sealed packets you can't return it (begs the question how your supposed to test it without opening the sealed packets)

Ended up having to quote the sale of goods act "Not fit for its purpose and not as described"

Advised that the sale of goods act does not cover self installs :)

Finally spoke to some git, that finally accepted to take it back for a complete refund, then he abruptly hung up on me. (yet to see the argument I have when i do try to return it).

There are some retailers that are just as bad as some consumers and will try any excuse not to take back an item for any reason. :(

Did you know it is a criminal offence to claim to be a lawyer when you are not?

Perhaps next time someone tries it, you could inform them of that. Should get an interesting reaction.

Why is it that you can pretty much guarantee that if someone says 'I know my rights' what they really mean is 'Big Fred down the road told me I can return it'. And why is it everyone seems to think they know their rights but never know their responsibilities?

  • this has to be one of the best posts on here, I fully agree as soon as someone says they know thier rights I want to burst out laughing.
Argos staff have been very helpful when I had problems, having bought and paid for a multigym with cash I cancelled the order after 6 weeks of waiting, I travelled to my local store 6 miles to be told I needed ID for a refund (didn't need ID to buy it) As I had nothing on me with my address on it the staff member actually told a fib to thier office that she had seen my driving license
I had a case once of a customer having bought a pair of horrid yellow curtains asked how to clean them, when told they are machine washable but I would reccomend dry cleaning to prolong thier life was told that she wanted to return them as she couldnt wash them.
I'm sure she just didn't like the colour!

Customers do you not realise you get a better response if you try and be polite in the forst instance.

My Mam used to work in a small shop.

Once a lady bought an expensive handbag and brought it back a few days later. She claimed she'd bought it to go with a wedding outfit, but when she got home she realised the bag didn't quite match. She asked for a refund as she'd got better matching bag elsewhere. This was processed as a gesture of goodwill.

However when she'd left and my Mam was putting the bag back into stock, she noticed a small stain on the bottom. On opening the bag and checking inside, under the tissue paper packing, there was some confetti and a book of matches. Obviously the lady had already used the bag for the wedding and brought it back after for a refund.

Following that, the shop owner decided he would no longer issue refunds for a change of mind, and would only issue refunds if items were faulty.

One stupid woman abusing the system spoilt it for everyone else.
Here I go again on my own....

They used to do that with clothing as well ... carefully remove labels .. wear garment ... reattach labels ... take it back as unsuitable. I am even aware of one woman who tried to return a dress as shop soiled AFTER she had spilled red wine on it ... the reason they KNOW she did it herself? one of the shop assistants was also at the wedding and someone falling over spilling wine does not go un-noticed.

Excellent rant thank you SomeGuy - some of your points come as no surprise as some customers try it on (beyond MSE principles).

I have always found Argos staff to be very helpful and the 16 day return policy is one of the best on the high street. I bought Christmas presents a couple of weeks ago and then found the prices plummeted - presents were promptly returned (not wrapped yet as not that organised!) and bought at the lower price, which means that I can now buy even more presents on the same budget.

    Keep smiling.
