    Are these all for misselling and to different companies. I tried lots of ways of complaining to the FOS about a certain company and nothing stuck... can you pm me with details etc....

    I sort of have the same with one of mine but I have obviously not put my complaints in right...I have mentioned all on one and was told that there are jurisdiction issues as this company were not under their jurisdiction until 2005 and my complaints are dated before that...
  • Finance companies that are registered with the FSA have to submit a montly audit of complaints, containing the reason for complaint and the outcome of said complaint, Now the FSA has a magic number as to how many complaints within a time period. This has obviously been risen since the mass approach to PPI complaints and the media coverage surrounding it.

    However it is only a matter of time now before they act on all these FP complaints and hopefully we will see a record fine, which will of course open the floodgates for more payouts to the consumer.
  • not sure how much ppi was for as I still havent recieved the SAR .How can they offer anything if they have no record of the account!
    The account ran for about 3 yrs 2003 - 2006 approx.I do have copies of a few statements.
    SPC £500 well will try very hard.

    Not me though as my complaint is pre they were regulated.:mad: They were GISC members of November 2001 and my loan was taken in 2000.

    They are hoping you will accept and go away. Get another complaint in or wait for the SAR and then fire back.
  • with regards to FP they were members of GISC and therefore the FSA rules carry on from the old regime.

    Just ask yourself, was the paperwork firstplus branded (including credit agreement)?

    Was the Insurance Firstplus branded?

    Were you told on the phone by firstplus that the responsibility of the loan and PPI were that of the Broker?

    Do you see any mention of the broker on the Insurance Policy Documents?

    Now you as a consumer, how on earth if you are not disclosed these key issues are you able to make an informed decision to take out the loan and PPI.

    now the magic question is.. would you have taken the PPI if you were made aware that your only recourse would be that of the broker who introduced you..

    And finally does the documentation clearly state that FIRSTPLUS is a member of either the FSA or GISC and then go on to promote the benefits of taking out a policy with a GISC member.

    Now to me its a no brainer as to who the responsibility lies.. if the policy document states about your protection because FP were a member of GISC or FSA, and now they are basically telling you that that means nothing..

    Then me thinks someone is in breach due to misrepresentation.

    Forget all about the who sold what and what you were told or what you were not told. The fact is would you of taken the loan or PPI where you aware that in the future you could do nothing about it because a broker referred you.

    Are you also aware that because the broker referred you that you would pay a higher interest rate to cover the brokers commissions... bet you didnt.

    marsh it makes no difference the auditory requirements are current and apply retrospectively
  • Marsh.. I see your predicament.. however, you still have a complaint under common law and there is a precedence which I will not discuss, however the 6 years claim times only starts once you have discovered the issue.

    I am 90% confident that you have a valid complaint, and I would seriously think about legal action.

    The FOS dont publish details of compaints, but the courts do and that aint good press.

    Have a think about it.. I can pass you over to a lawyer that is handling my case at the moment.
