    Hi Di
yeah its about PPI but i didnt wana intrude on someone elses thread but here goes! Me and my boyfriend took out a loan with HSBC about 4 years ago and was told we had to have PPI as he was self employed! A year or so later we took out another loan without PPI and since then we have consolidated those two loans with a two credit cards, which i think may have had PPI but cannot remember. Our current loan does not have any PPI but is there a way we can claim back the PPI on the previous loan and possibly the credit cards as technically we are still paying for them. Also i do not have any paperwork from the loans or cards will this make a difference.
Daisy just noticed you have no paperwork but you could get all paperwork from these companies by requesting a SAR from them. I will post a template letter in a min. You pay them £10 for all the information they hold of you and it includes things from the accounts going back 6 years usually. It may help.

Is there a time limit for reclaiming missold PPI insurance. Back in 1996, we took out a 4 year unsecured personal loan with TSB for £8,500 @ 14.9% APR. The branch manageress insisted at the time of our application, that personal loan payment insurance was taken. She made it quite clear that to refuse this insurance would result in us not qualifying for the loan. As we were desparate for the money, like fools we agreed. I've still got the paperwork with old account numbers on and details of how much PPI cost. It's quite horrifying - the total cost of protecting an £8,500 loan was £1894.00 or £39.47 a month. I recall settling the loan approx 18 months early (took out another loan) and receiving around £270 back for early settlement but can't remember what this early settlement payment was in relation to.

A similar situation occured again on 3 August 1998 when we took our mortgage with Cheshire Building Society. We were offered the mortgage on condition that we took out their Mortgage care policy. This policy is detailed on the offer of advance from the Cheshire but wasn't in the conditions of advance. On 16th August 2000, we cancelled this policy and took income protection insurance with Norwich Union. Again we have all paperwork in relation to Mortgage care policy with the Cheshire.

Anyone able to offer any advise as to whether or not it's worth pursuing a claim for missold PPI?
If you have the paperwork then there is no harm in trying this.

Just take a look at the link here and see what you can add and delete from the template letter. Its always best to do your own from this. There are lots of reason on there for the misselling so pick out the ones that are applicable to yours.

You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS (if you can?????) or offer to settle.

I had one like that from the co-op but what are you complaining about? Is it the misselling of the PPI? If it is then perhaps you could make your complaint and also note to them that there is no signature of yours on the actual agreement too.;)

Well if there is no sig and can write off the loan i rather do this
or if the mis selling is my other option:confused:

Daisy, a template for the SAR is here

If the loan was in joint names then both have to sign this sar otherwise anything about another person is not included and also its one SAR request per company too as if the credit cards and loans were with the same then you only need send one.

    SAR - SUBJECT ACCESS REQUEST

    Dear

    Re: Account number:

In the first part under the Data Protection Act 1998:

Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.

For the avoidance of any and all doubt, I reiterate:

I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

You have 40 days in which to comply with this request.

This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    Yours Sincerely

That would be best asked on the loans section as this is about PPI misselling.;)

Its a good idea then to request a SAR (Subject Access request) for this information where they should provide everything they have on you.

I see our Marshallka has posted this up and when you receive these, check through everything as much as you can, I expect you may hopefully find some very useful info within the documents you receive.;)

    Good luck.
