    Good luck with that one Dreamer. You have to think positive but easier said than done. Waiting is the pain in the bum and its not long now. I really hope its good news for you dreamer. You need some after the time you have had.

    LOL - that is what new year means to me. New beginnings and out with the old and in with the new. I always do draws, cupboards, curtains, etc. I like a new looking house in the NEW year..;)

    I managed to get myself in debt in January after a family member left me in debt I struggled since 2007 trying to pay off impossible amounts and went to the CCCS in January 2007. I have since been paying what I can on the debts owing. One of these was my overdraft with Barclays. I had insurance and applied to company based in Ireland who took 3 weeks to send the form While I started to fill in the form, Barclays then sent me a letter to say they had closed my account. Having started to read the insurance it became clear that I could not access it as I was not eligible even though the bank person said I was. Had trouble as everyone had with contacting Mercers and wrote to the main branch in London with my complaint who then sent me a £20 cheque for my difficulties but still failed to point out that I should have a claim on insurance. I was definately miss sold this as I had been on incapacity through illness for a long time then worked for 4 months before retiring. This the bank all knew for a very long time. I am now going to try and get my head around trying to get my overdraft paid, via the miss sold route. I also see on the forum that someone had a barclaycard with insurance is this standard? because if it is then I should be able to make a claim no one at barclays has pointed me in this direction. I have also discovered that I think I am covered for insurance also on my M&S card and maybe my egg card too. Don't know about my halifax card. Why have companies like this not pointed out that I have insurance if it is there? before sending it to debt collectors. I have been very ill and only now feel able to tackle all this. Any advise would be truly welcome

    Hi, were you on incapacity for illness at the time you actually took the loan/cards out..???

    How long have you been incapacitated and for what reasons if you don't mind us asking and not made the claims for?? Are you saying that the PPI would be useful to you??
  • I've been contacted by an adjudicator for my Barclays claim. He says that he has written to them for more info and will be contacting me shortly. So heres hoping that it all goes to plan and comes to an end asap. happy new year to everyone.

    Hi there hun

    Sorry to hear of all your problems.

    Insurance should be optional for any finance.

    Please could you confirm when you had taken this out?

    I would check out all you have if you still have the agreements for your loans/credit cards etc, and if you still have the terms and conds for these.

    If not you can always request a SAR, known as a Subject access request where they will supply everything they have on you.
    They have 40 days to comply and as always post by recorded delivery for your proof of posting and to keep a check on the 40 days timescale they have.

    However there is a £10 charge for this either by cheque or postal order.

    If you want the SAR template for this one of us will post up for you, I will post up shortly in another post when I come across it.;)

    There is some useful PPI info which will give you more of an idea of how people were/are mis sold, they have 8 weeks to respond in full, again post by recorded delivery.
    There is also a template letter you can use to help guide you but add your own reasons and as much info as possible to back your complaint.

    Let us know how you get on in case further letters have to be sent if not successful first time round, or until they give the final response and mention the financial ombudsman service (FOS).

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.





    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.
