Yes I know its a difficult one and must keep trying and with a bit of luck the FOS will see this your way, where I think they should, because yours was certainly unfair.:rolleyes:

Going to call it a night tonight as I want to wake up refreshed tomorrow for a change. I am feeling really sluggish with all this rich food and my stomach is hurting... I have eaten too much again..:o .

I have found that bit where that complaint was upheld by the FOS and they see that the terms of the contract where that person had the rebate that was unfair were contrary to the Unfair terms in Consumer contracts. I just hope they listen and uphold mine. Doubtful though as no-one has ever posted winning on this one.

It seems they are very hesitant in sending it to me, I requested for it on the 6th Dec, I know it does not help with xmas, but they do normally confirm the emails as well, which I sent last week to remind them......

No they cannot. They should have sent it with the SAR anyway...I told you I had to request mine too from Firstplus by serperate letter. They must know you have a chance with this maybe...;) . Its only a chance though like mine but worth a shot.

I will go through my SAR again but don't seem to have anything there, and I did also tell them that on the email that I have not received that part and would appreciate it if they could send it.
I will keep on, just don't know how long to give them as they've had a good few weeks already to supply it and nothing...... .

So what exactly do I need to look out for on this altogether?

On the back of the agreement you once posted on here it stated that you could request a copy of the policy documents whenever you wanted I think I remember. I never had any of mine from Firstplus and I complained about not having them during a phone call in 2003 and they have sent details of this call. I still never had them then and then when I requested the SAR they should have sent them again but never did and I noticed this and sent a seperate letter to them for this. They then sent me what THEY say was a copy of the terms and conditions of my original policy and this is where the FOS asked me to state in a letter to them (or email!!) that the terms and conditions that I was sending to them were what FIRSTPLUS actually stated were mine and the ones they sent to me AFTER the loan was settled. FOS asked me to actually state that to them and I did... .

Yes your right, it did read that i can request for these, and all I have here is underwriters paperwork, a document headed HFC with just mine and hubbys personal details on and what I posted to you, many copies of them, and the calculations.....nothing else though.
It seems I may be in the same situation as you then maybe, although yours is proven as unfair, goodness knows what it will say on mine.
